11-1-10: VESTED RIGHTS:
   A.   Single-Family Residential Development: Development rights in single-family residential development shall vest upon recording of a final plat of such land. If construction is not commenced on such land within five (5) years of recording a plat, the development rights in such shall expire.
      1.   Except for lots in a recorded plat, any remaining contiguous lots or tracts of land within the area divided under this rule held in common ownership at the conclusion of said five (5) year period shall be considered a single, unplatted lot and subsequent divisions of said lot shall be platted in conformance with the subdivision regulations then in effect.
   B.   Nonsingle-Family Residential Development: For all purposes other than single-family developments, the right to use land for a particular purpose shall vest upon the issuance of all permits required for such use by the city, and construction has begun, and substantial amounts of work have been completed under a validly issued permit. Persons who obtain a validly issued permit on a lot or tract of land created under the provisions of the previous subdivision regulations shall be permitted to develop said property so long as the permit issued does not expire. Failure to start construction under said permit before the expiration of the permit shall not protect the owner from the provisions of these regulations or the Scott City zoning regulations.
   C.   Applicable Laws: To obtain final plat approval, the applicant shall be in compliance with all local laws and regulations applicable at the time that the preliminary plat was submitted to the planning commission, except that the applicant shall comply with those local laws and regulations in effect at the time that the final plat is considered for approval by the commission, provided that the planning commission makes a determination on the record that compliance with any of those local laws and regulations is reasonably necessary to protect public health and safety.
