(A) The Mayor shall appoint the Energy Commission.
(B) The Commission shall consist of five members who shall be residents of the municipality or the two-mile zoning jurisdiction. To the greatest extent possible, the Commission shall represent a cross-section of the municipality in that it is comprised of members from different professions and occupations.
(C) The members of the Commission shall serve a three-year term of office beginning at the first meeting in December of the year of their appointment, or until a successor is appointed or the member is reappointed; except that the members first taking office shall serve, as designated by the Mayor at the time of appointment, two for a term of one year, two for a term of two years, and one for a term of two years, and any member appointed to fill a vacancy shall serve for the remainder of the term for which his or her predecessor was appointed.
(D) The Mayor, by and with the consent of a majority of the members of the City Council, may remove any member of the Commission. The Commission and its members shall serve without compensation and may be required, in the discretion of the Governing Body, to give a bond in a sum set by resolution of the Governing Body, and conditioned upon the faithful performance of their duties. At the Commission’s first regular meeting of each calendar year, the Commission shall organize by selecting from its membership a Chairperson, Vice Chairperson, and Secretary. It shall be the duty of the Secretary to keep full and correct minutes and records of all meetings and to file the same with the Municipal Clerk, where they shall be available for public inspection during regular business hours.
(E) The Governing Body shall fund the Energy Commission from time to time as may be agreed to by the Governing Body from the general fund of the municipality. A majority of the Commission shall constitute a quorum for the purpose of doing business. The Commission shall meet at least once each quarter of the calendar year and shall be subject to the open meeting statutes of the State of Nebraska. Special meetings may be held upon the call of the Chairperson, or any three members of the Commission.
(F) It shall be the duty of the Commission to make and adopt plans for the energy development and conservation of the municipality, including any areas outside its boundaries which, in the Commission’s judgement, bear relation to the planning of the municipality and within the two-mile zoning jurisdiction of the municipality.
(G) All actions by shall be subject to the review and supervision of the Governing Body. The Commission shall be responsible for making the reports and performing any other duties as the Governing Body may, from time to tome, designate. No member of the Energy Commission shall serve in the capacity of both Chairperson and Secretary of the Commission.
