§ 31.36 STREET COMMISSIONER.
   (A)   The Street Commissioner shall be subject to the orders of the Mayor and Council and under the supervision of the Committee on Streets; shall have general charge, direction, and control of all work on the streets, sidewalks, culverts, and bridges of the municipality; and he or she shall also perform any other duties as the Governing Body may require. As Sidewalk Inspector, he or she shall have general control of all sidewalks and sidewalk spaces. It shall be his or her duty to see that sidewalks and sidewalk spaces are not unlawfully occupied. He or she shall report all obstructions thereon and unlawful use of the same to the Governing Body. He or she shall have authority to go upon any private property and to enter any areaways under sidewalks at reasonable hours. He or she shall serve all notices pertaining to sidewalks, crossings, and alleys and shall keep in a suitable book an accurate record of each notice so served with the time and manner of the service. He or she shall likewise keep a record of all sidewalks ordered built. It is hereby made the duty of the Street Commissioner to personally view and inspect any and all lots and parcels of land for weeds and worthless vegetation thereon at least once in each month during the growing season and if rank and noxious weeds or worthless vegetation shall be found growing upon any lot, lots, or lands within the city, or upon the streets and alleys abutting upon any lot, lots, or lands, the owner or owners of the lot, lots, or lands shall be required to destroy and remove the same therefrom and from the streets and alleys abutting thereon. If the owner or owners fails, neglects or refuses, after five-days’ notice by publication or by personal service, to destroy or remove the same, the Street Commissioner shall cut and remove or cause the weeds or vegetation to be cut and removed as herein provided and to report the cost thereof in writing to the Governing Body, and the bill shall be audited and paid by the municipality, and the amount thereof shall be assessed against the lot, lots or lands as a special tax thereon, and be levied and collected as are other taxes of the city. It is the duty of the Street Commissioner personally to view sidewalks contiguous to any lot, lots, or lands within the municipality to ascertain if any snow, ice, mud, or other obstructions encroach into or upon the sidewalks. In the event any such encroachments shall be found to exist, it shall be the duty of the owner or owners of the abutting property to remove the same. If the abutting property owner or owners refuses or neglects, after reasonable notice by the Street Commissioner, it shall be the duty of the Street Commissioner to remove the same or cause the same to be removed, and to report the cost thereof to the Governing Body. The bill shall be audited and paid by the municipality out of the Street Fund, and the Governing Body shall assess the cost of the notice and removal of the encroachment against the abutting property. The special assessment shall be known as a special sidewalk assessment and, together with the cost of notice, shall be levied and collected as special taxes in addition to the general revenue taxes, and shall be subject to the same penalties and shall draw interest at 7% per annum from the date of the assessment. Upon payment of the assessment, the same shall be credited to the Street Fund.
      (B)   The Street Commissioner shall keep a daily record of work and type of work completed by each employee of the Street Department and the number of hours required therefor. The Street Commissioner shall be provided with printed forms for such purpose. One copy shall be given to the Chairperson of the Street Committee detailing work completed for the previous week. The Street Commissioner shall file copies of the work record each month with the Municipal Clerk for presentation to the Governing Body.
