(A) It shall be unlawful for any person or persons to sell fireworks, of any description whatsoever, other than consumer fireworks at retail as defined by Nebraska Statutes; provided, that all consumer fireworks may be sold only between June 24 and July 5 and between December 28 and January 1 of each year; provided, that fireworks of any description are permissible for purposes of public exhibitions or displays as authorized by the Governing Body, and further provided that the vendor shall secure a license prior to the sales. Application shall be filed with the Municipal Clerk upon forms supplied by the municipality requesting the information and documents as the Governing Body may deem necessary as to whether to grant the license. Upon the determination to grant the license, the Governing Body shall direct the Municipal Clerk to collect the appropriate fee and issue the license. Any license so issued may be revoked at any time by the Governing Body upon proper notice and hearing, if one is requested by the licensee. No fireworks shall be sold in the Dwelling District (R) of the City of Schuyler.
(B) The following regulation shall apply to the premises from which fireworks shall be sold, to wit:
The following commercially made signs, with at least four inches by one-half inch wide block lettering of permanent design of black against white background shall be installed on all four sides of the structure from which fireworks are to be sold. Said signs shall state:
(1) FIREWORKS/NO SMOKING WITHIN 50 FEET;
(2) NO FIREWORKS DISCHARGED WITHIN 300 FEET;
(3) NO PARKING WITHIN 12 FEET;
(4) FIREWORK DISCHARGE IS ONLY PERMITTED IN THE CITY:
(a) JUNE 25 - JULY 2 10:00 a.m. - 11:00 p.m.
(b) JULY 3 AND JULY 4 10:00 a.m. - 11:59 p.m.
(c) DECEMBER 29 10:00 a.m. - 10:00 p.m.
(d) DECEMBER 30 10:00 a.m. - 11:00 p.m.
(e) DECEMBER 31 10:00 a.m. - JANUARY 1 1:00 a.m.
(C) A commercially made sign with an image for (i) no smoking and (ii) no explosions shall be displayed at each entrance of any structure from which fireworks as to be sold.
