§ 151.08 ESTABLISHMENT OF BOARD OF APPEALS.
   In order to hear and decide appeals of orders, decisions or determinations made by the Building Official/Code Official relative to the application and interpretation of the Building Code and International Property Maintenance Code currently adopted by the City of Schuyler, Nebraska, there shall be and is hereby created a Board of Appeals consisting of five members who are qualified by experience and training to pass on matters pertaining to building construction, and who are not employees of the jurisdiction. The Building Official/Code Official shall be an ex-officio member of, and shall act as secretary to the Board, but shall have no vote on any matter before the Board. Each member of the Board of Appeals shall be appointed by the Mayor and approved by the City Council, and shall hold office for a three-year term and is removable for cause by the appointing authority upon written charges and after a public hearing. Vacancies shall be filled for the unexpired term of any member whose term becomes vacant. The initial members of the Board of Appeals shall have staggered terms with two members being appointed to serve three years, two members to serve two years and one member to serve one year. The Board shall adopt rules of procedure for conducting its business, and shall render all decisions and findings in writing to the appellant with a duplicate copy to the Building Official/Code Official. The City Council may determine any compensation to the Board members by separate resolution, and until the resolution is passed, no compensation shall be paid to the Board members.
