§ 110.04 APPLICATION FOR LICENSE.
   (A)   The application for a vending license shall contain all information relevant and necessary to determine whether a particular license may be issued, including but not limited to:
      (1)   The applicant's full name, permanent address, telephone number and proof of identity;
      (2)   A brief description of the nature, character and quality of goods, wares or merchandise to be offered for sale;
      (3)   The specific location, if any, in which the vendor intends to conduct business, and the length of time during which it is proposed the business will be conducted;
      (4)   If the applicant is employed by another, the name and address of the person, firm, association, organization, company or corporation;
      (5)   If a motor vehicle is to be used, a description of the vehicle together with the motor vehicle registration number and license number; and
      (6)   A sales tax permit as required by Neb RS 77-2705.
      (7)   If the applicant intends to operate from a private space, the location, and written permission of the record title owner of the private space;
      (8)   A background check will be conducted annually by the Police Department/Colfax County Sheriff/City of Schuyler Staff with all applicable information being provided to the city's licensing specialist. The applicant shall submit to photographing. No permit shall be granted to any person:
         (a)   Who has been convicted for a sex crime as defined by Neb RS 29-4001 through 29-4014, or any indecent exposure for which they are still subject to registration requirements;
         (b)   Who has a conviction or date of discharge from prison, jail, probation, or parole within the last five years for all other indecent exposure (Class 1 misdemeanor);
         (c)   Who has a conviction or date of discharge from prison, jail, probation, or parole within the last ten years of application for a crime of violence;
         (d)   Who has a conviction or date of discharge from prison, jail, probation, or parole within the last five years of application for felony possession/distribution of controlled substances;
         (e)   Any fraud, misrepresentation or false statements contained in the application for a permit or made in connection with the selling of any products, which is the subject of these guidelines;
         (f)   Conviction of the applicant of any felony or misdemeanor involving a crime of moral turpitude; or
         (g)   For any good cause.
   (B)   Any conviction for an offense in another state which, if committed in this state, would be a violation of one of the offenses listed above shall be used to determine if applicant is eligible for a license.
