(A) It shall be the duty of the police officers of the City of Schuyler, Nebraska, to report:
(1) The owner, when known, of each licensed vehicle that has been parked in violation of any of the provisions of this chapter and the location of each limited parking space wherein a vehicle is parked, or has been parked, in violation of any of the provisions of this chapter;
(2) The state license number of the vehicle if the vehicle is required by law to be licensed;
(3) The date and time the vehicle was found to be parked in violation of any of the provisions of this chapter; and
(4) Any further facts or knowledge which may be necessary for a thorough understanding of the circumstances attending the violation.
(B) Each police officer shall also attach to the vehicle at the time the vehicle is found in violation, a notice to the owner or operator thereof that the vehicle is or has been parked in violation of a provision of this chapter. The notice shall describe the violation and instruct the owner or operator that he or she may appear before the appropriate city official, admit the allegation, waive the court appearance, and pay the appropriate fine. Fines shall be imposed by waiver and paid as follows:
1-5 days | $15 |
Over 5 days | $50 |
(C) For every subsequent parking offense in the City of Schuyler by the same offender in the same calendar year, add $15 per offense to each of the categories 1-5 days and over five days as set forth above. DAYS are defined as business days.
(D) The first $5 of the foregoing fine so collected shall be retained by the city for administration fees. All the remaining portion of the fine so paid shall be paid to the City Treasurer and deposited in the City Road Fund. In the event any such owner or operator shall desire to contest a citation issued, or shall fail to appear in response to the notice set forth above, the owner or operator shall be liable to prosecution in the appropriate court and the imposition of a fine as set forth in § 70.99.
