§ 119.005 INSPECTIONS; INVESTIGATIONS; ANALYSES.
   (A)   Inspection Upon Application.
      (1)   Upon receipt of any application for a license or permit where an investigation or inspection is required before the issuance of such permit or license, or where an inspection or investigation shall be deemed reasonably necessary or appropriate, the Village Clerk, shall refer the application to the appropriate officials for the making of such investigation or inspection.
      (2)   The official to whom the application has been referred shall make a report thereon, favorable or otherwise, after receiving such application or a copy thereof.
      (3)   Except as otherwise provided, upon the receipt of all related investigative reports and if such reports show that the applicant meets all the requirements of law with reference to the issuance of the license or permit applied for, the Village Clerk shall issue the license.
   (B)   Licensed Premises Inspections; Analyses.
      (1)   When inspections of the premises used for or in connection with the operation of a licensed business or occupation are provided for or required by this Code or ordinance, or are reasonably necessary to assure compliance with the provisions of any law, or to detect violations thereof, it shall be the duty of the licensee or the person in charge of the premises to admit hereto, for the purpose of making the inspection, any village officer or employee who is duly authorized to make such inspection at any reasonable time that such admission or entry is requested.
      (2)   When an analysis of any commodity or materials is reasonably necessary to assure compliance with the provisions of any ordinance or regulation, or to detect violations thereof, it shall be the duty of the licensee or the person in charge of the premises to give to any duly authorized Village officer or employee requesting the same sufficient samples of such material or commodity for such analysis upon official request. Such an analysis shall be conducted at the expense of the licensee or permittee or the person desiring the license or permit.
      (3)   In lieu of, or in addition to, any other penalty which may be provided, the Village Manager/Comptroller may suspend or revoke the license of any proprietor of any licensed business in the Village who refuses to permit any officer or employee to make that inspection or take the sample to make the inspection or take an adequate sample of the material or commodity or who interferes with the officer or employee while in the performance of his or her duties; provided however, that no license shall be subject to suspension or revocation for such cause unless such officer or employee has been refused permission to enter upon the premises in the name of the Village after first having presented a warrant authorizing such entry.
   (C)   Inspection or Re- inspection Service Fee. Whenever within this Code an inspection of premises is provided to be made by officials and/or employees of the Village of Schiller Park, the purpose of which inspection is to determine eligibility for the issuance of a business license or any renewal thereof and/or for determining continuing compliance with applicable Village regulations and codes, and to that end, if upon an inspection such premises are found to be not in compliance with such regulations and/or codes and an additional re-inspection is required because of such noncompliance, the first re- inspection will be made without charge. Thereafter, the permittee/licensee will be assessed a noncompliance service fee of $90 for each subsequent re-inspection. Payments of each such noncompliance service fee must be made in full prior to the license or any renewal thereof being issued or within thirty (30) days from the invoice date, as the case may be. Failure to make full payment as required will serve as grounds to deny the issuance of such license or permit, or any renewal thereof, or result in the suspension or revocation of any license or permit in effect at the time payment is required. Nothing herein shall be deemed a waiver on the part of the Village from proceeding with suspending or revoking any business license, building permit, or other license and/or permit as a result of repeated violations or failures to comply with applicable Village codes and regulations.
