A Grantee shall comply with all applicable Federal, State, and local rules, regulations, and construction codes, and about which the Village has adopted, governing the construction, operation, maintenance, and installation of the Cable System, as such rules, regulations, and codes are in force as of the time of the installation or other work. All installations shall be underground in those areas of the Village where public utilities providing both telephone and electric service are underground at the time of installation. In areas where either telephone or electric utility facilities are above ground at the time of installation, a Grantee may install its service above ground, provided that at such time as those facilities are required to be placed underground, the Grantee shall likewise place its services underground. Where Grantee's existing Cable System facilities are placed underground, any reconstruction of such facilities shall be underground as well. At such time as aerial facilities are required to be placed underground by the Village or are placed underground for a reason out of a Grantee's control, a Grantee shall likewise place its services underground on the same terms and conditions for telephone and electric utilities. Where not otherwise required to be placed underground by this Chapter, a Grantee's Cable System facilities shall be located underground at the request of the property owner, provided that the excess cost over standard aerial location shall be borne by the property owner making the request.
