(A) The Grantee shall construct and operate the Cable System to comply with the FCC technical standards contained in Part 76, Subpart K of the Commissions rules and regulations, as updated and amended from time to time. The Grantee shall perform all tests necessary to determine compliance with the FCC technical standards. Tests shall include, at minimum, proof-of-performance tests required by FCC Rule Section 76.601 and such additional or repeat tests involving specified Subscriber terminals as may be required to determine compliance with the FCC technical standards.
(B) Written records of test results shall be maintained at the Grantee’s local office and made available for inspection by the Village. Upon request, Grantee shall provide to the Village within thirty (30) days after the end of the calendar year, written reports of the Grantee's bi-annual proof of performance tests conducted pursuant to FCC standards and requirements and such additional or repeat tests involving specific Subscriber terminals as may be required to determine compliance with the FCC technical standards.
