§ 110.58 EMPLOYEES.
   (A)   It shall be unlawful to employ in any premises used for the retail sale of alcoholic liquor any person who is afflicted with, or who is a carrier of any contagious, infectious or venereal disease and it shall be unlawful for any person who is afflicted with or is a carrier of such disease to work in or about any premises or to be engaged in any way in the handling, preparation, or distribution of such liquor.
   (B)   No licensee licensed under the provisions of this chapter shall deny or permit his agents and employees to deny any person the full and equal enjoyment of the accommodations, advantages, facilities and privileges of any premises in which alcoholic liquors are authorized to be sold subject only to the conditions and limitations established by law and/or ordinance and applicable alike to all citizens.
   (C)   The Village President and Board of Trustees of the Village find that it is necessary and advisable for licensees and licensee's employees to be apprised of the requirements of this Chapter and State law directly affecting the conduct of businesses operating under liquor licenses. The Local Liquor Control Commissioner is hereby authorized to require persons who sell or serve open and unopened containers of alcoholic beverages at retail and anyone whose job description entails the checking of identification for the purchase of open and unopened containers of alcoholic beverages at retail or for entry into the licensed premises to have a valid Beverage Alcohol Sellers and Servers Education and Training ("BASSET") seminar certificate of attendance.
      (1)   A certificate of attendance shall be good for three years. Every person required to attend a BASSET seminar or program must complete said instruction at the time of issuance of a liquor license or renewal or within one hundred and twenty days after the person begins his or her employment, whichever is later. Village instruction may be offered at the Village's police station or other designated location on such dates and at such times as determined by the Local Liquor Control Commissioner.
      (2)   A copy of the certificate of attendance for each person required by this Section to attend a BASSET seminar or program shall be submitted to the Local Liquor Control Commissioner along with each initial application and each renewal application for a liquor license and within ten days after receipt by a new employee, or a current employee required to complete instruction within the time period set forth in subsection (1) above, during the license term.
      (3)   Failure of an owner, manager, or employee to attend a seminar or program, when specifically required by the Local Liquor Control Commissioner, shall constitute a violation of this Section by the licensee.
