§ 30.095 POWERS AND DUTIES AS FISCAL AGENT.
   (A)   The Village Manager/Comptroller shall be the fiscal agent of the Village and as such shall be charged with and shall exercise general supervision over, and establish procedures for, all officers of the Village charged in any manner with the receipt, collection or disbursement of the Village revenues and/or funds, including funds required to be in the custody of the Village Treasurer.
   (B)   The Comptroller/Manager shall have custody and control of all documents, including debts, mortgages, leases, contracts, judgement orders, notes, bonds and evidence of indebtedness belonging to the Village except such as are directed by law or ordinance to be deposited elsewhere. He or she shall have supervision of the issuance and sale of all bonds, warrants and obligations and shall have supervision over the accounting work of the Village.
   (C)   Specifically, but not in limitation of the above, he or she shall have the following powers and duties:
      (1)   Before the annual budget ordinance is prepared by the corporate authorities, he or she shall submit to the corporate authorities a report of the estimate of the money necessary to defray the expenses of the Village during the next fiscal year and in that report shall classify and detail the purposes of expenditure, the aggregate income of the preceding fiscal year, the Village liabilities and other information as is necessary to assist the Village President and Board of Trustees to adopt an annual budget.
      (2)   For the purpose of preparing the aforesaid estimate, he or she is authorized to require all officers to submit statements of the condition and expenses of their respective offices or departments, a description of proposed Village improvements and the probable expense thereof, a description of all unperformed contracts and a statement of the amount of all unexpired appropriations of the preceding year.
      (3)   He or she shall recommend to the President and Board the salaries to be paid each appointive subordinate employee of the Village.
      (4)   With the approval of the President and Board, may consolidate, combine, reorganize or unite positions under his or her jurisdiction.
      (5)   He or she shall purchase all materials, supplies or equipment subject to and pursuant to directives and appropriations made and provided by the President and Board and subject also to the statutes of the state pertaining to creation of liabilities against the Village and pertaining to the expenditures or appropriations of the money of the Village.
      (6)   Each month, he or she shall cause to be prepared and shall present to the President and Board a statement showing the exact financial condition of the end of the preceding month.
      (7)   He or she shall give additional reports and information concerning the fiscal matters of the Village as, from time to time, may be required by the President and Board.
      (8)   He or she shall perform the duties and have the powers as are fixed and conferred upon him from time to time by the President and Board.
      (9)   He shall perform such other duties as may be prescribed by ILCS Ch. 65, Act 5, or as may be required of him by ordinance or resolution of the President and Board of Trustees, including but not limited to the conveying of a license, that is, an incorporeal hereditament or a nonpossessory interest in land, to any person, firm, or corporation for the construction, installation, and/or maintenance upon or over public land owned or controlled by the Village by such person, firm, or corporation of awnings, automatic lawn sprinkling systems, private roadway improvements, and roadway entrance markers or other public, charitable, or aesthetic insignia.
         (a)   The license shall not be granted or conveyed, however, until:
            1.   The grantee shall have presented to the Village specific drawings, plans, and specifications for the improvement to be erected and constructed upon the public lands involved.
            2.   The grantee and the Village Comptroller/Manager shall sign an agreement approved by the Corporation Counsel, which agreement shall include but not be limited to provisions: whereby the grantee shall hold harmless the Village, its agents, employees, and representatives from any causes of action arising out of such construction, installation, and/or maintenance of such improvement in, upon, or over the said public property; whereby the grantee shall pay for an insurance policy naming the Village as an insured party, and providing coverage for liability (including defense of actions) arising out of incidents resulting from the issuance of such license; and whereby the grantee shall reimburse the Village for its engineering, legal, and inspectional costs encountered by its issuance of such license.
         (b)   The document containing the license shall set forth the legal description of the land, shall clearly indicate that the grantee will have no possessory interest or estate in the land so described, and shall terminate at the pleasure of the Village.
         (c)   Both the license and the hold harmless agreement above-described shall be filed with the Village Clerk within 10 days after their execution, whereupon the Director of Bureau of Fire Prevention of the Village shall have the power and authority to issue a building permit pursuant to the terms of said license.
