§ 76.14 PENALTY.
   (A)   The owner or lessee of a motor vehicle is subject to a penalty of one hundred dollars ($100.00) per automated traffic law violation. In the event that such penalty is not paid within fourteen (14) days after service of a final determination of liability, an additional one hundred dollar ($100.00) late penalty shall be imposed.
   (B)   A penalty shall not apply if the driver of the motor vehicle received a Uniform Traffic Citation from a police officer at the time of the violation for the same offense and either paid such citation or successfully contested said citation.
   (C)   The Village may not charge court costs or hearing fees to persons found liable after exercising their right to appear and contest the violation at an administrative hearing.
   (D)    The Village, through its Treasurer, Clerk, Police Department, Village Attorney, Administrative Adjudication Program, and/or any other designated agent of the Village, may establish procedures for the collection of the civil penalty imposed. The Village may pursue all available remedies, allowed by law, to collect fines and payment of penalties owed to the Village. The Village may retain attorneys and private collection agents for the purpose of collecting any default in payment of any fine or penalty or installment of that fine or penalty. Any fees or costs incurred by the Village as a result of these collection activities (including, but not limited to, attorneys, private collection agents, or other authorized personnel) shall be assessed against the violator.
   (E)   Said collection costs shall include an administrative fee of thirty five percent (35%) assessed on the default fine, penalty or outstanding installment amount.
   (F)   In the event a judgment is entered against a violator of this chapter, the judgment amount shall be the amount of the unpaid debt remaining on the date the judgment is entered plus litigation and collection costs, attorney fees and the amount representing all fines and penalties assessed pursuant to this section. In addition to all of the above, the balance of debt remaining unpaid on the date the judgment is entered shall be assessed an administrative penalty of six percent (6%) per annum during which the debt remains unpaid.
