§ 116.035 FOOD PURVEYOR LICENSE REQUIRED; COMPLIANCE.
   (A)   No person or entity shall establish, maintain or operate a food establishment within the Village who does not have a valid Food Purveyor License issued by the Regulatory Authority, which is neither revoked nor suspended.
   (B)   Only a person or entity who is the owner of the food establishment; who complies with the requirements of this chapter, the general licensing provisions, and the Illinois Food Service Sanitation Code as herein adopted; who agrees to allow the Regulatory Authority access to the food establishment and to provide the Regulatory Authority with required information; and who pays the applicable license fee at the time the license application is submitted shall be entitled to receive or retain such a license.
   (C)   The Food Purveyor License for a food establishment shall be valid from June 1 through May 31 of the next year unless sooner terminated by revocation or suspension as provided herein. Each Food Purveyor License must be renewed annually.
   (D)   When structural, plumbing, electrical, ventilation or similar defects exist in an established food facility, that may require a significant expenditure to correct, but are not considered to be an imminent health hazard, a conditional license may be granted at the discretion of the Regulatory Authority after all applicable license fees are paid. A conditional license may be issued to operate for a period not to exceed ninety (90) days and may be renewed not more than once.
   (E)   The annual fee for a Food Purveyor License shall be set from time to time by the Village President and Board of Trustees.
   (F)   The Food Purveyor License is in addition to the annual Village of Schiller Park Business License. It shall be unlawful for any person who does not possess a valid annual Village of Schiller Park Business License, which is neither revoked nor suspended, to obtain a Food Purveyor License within the Village.
