In enforcing the provisions of this chapter, the Regulatory Authority shall assess existing equipment that was in use before July 1, 2018 based on the following considerations:
(A) Whether the equipment is in good repair and capable of being maintained in a sanitary condition;
(B) Whether food-contact surfaces comply with the Illinois Food Service Sanitation Code;
(C) Whether the capacities of cooling, heating, and holding equipment are sufficient to comply with the Illinois Food Service Sanitation Code; and
(D) The existence of a documented agreement with the license holder that the equipment will be replaced with equipment that complies with this chapter if:
(1) The Regulatory Authority directs the replacement because the equipment constitutes a public health hazard or nuisance or no longer complies with the criteria upon which the equipment was accepted,
(2) The Regulatory Authority directs the replacement of the equipment because of a change of ownership, or
(3) The equipment is replaced in the normal course of operation.
