§ 30.035 EMERGENCY POWERS.
   (A)   In accord with the statutes of the state, made and provided, the corporate authorities of the Village hereby grant to the Village President the extraordinary power and authority, by executive order, during a state of emergency, such of the powers normally reserved to the corporate authorities as may be reasonably necessary to respond to the emergency.
   (B)   The Village President shall not exercise such extraordinary power and authority except after his signing a statement, under oath, that a state of emergency exists. Such sworn statement shall set forth facts substantiating such findings, describing the nature of the emergency and declaring that a state of emergency exists and shall be based upon the following standards for determination. The existence of:
      (1)   A riot or unlawful assembly characterized by the use of actual force or violence or any threat to use force if accompanied by immediate power to exercise same by three or more persons acting together without authority of law; and/or
      (2)   Any natural disaster or man-made calamity, including flood, conflagration, cyclone, tornado, earthquake or explosion resulting in the death or injury of persons or the destruction of property to such extent that the extraordinary measures must be taken to protect the public health, safety, and welfare.
   (C)   Such statement shall be in the form of a sworn proclamation and following its signing shall be filed with the Village Clerk as soon as practicable.
   (D)   Unless sooner terminated by a proclamation of the Village President indicating that the civil emergency no longer exists, the Village President's emergency proclamation shall terminate at the end of 48 hours or the next regular meeting of the President and Board of Trustees, whichever first occurs. The Village President shall have the power by sworn proclamation to reinstate his statement of the existence of a civil emergency upon the expiration of the original sworn proclamation.
   (E)   Upon the issuance of the original sworn proclamation authorized in division (D) above, the Chief of Police shall notify the news media situated within the Village and shall cause three copies of the proclamation declaring the existence of the emergency to be posted at the municipal building, the post office, and the fire department headquarters.
   (F)   After the proclamation of a civil emergency, the Village President may, in the interest of public safety and welfare:
      (1)   Order the closing of all retail alcoholic liquor stores, including taverns and private clubs or portions thereof wherein the consumption of intoxicating liquor and beer is permitted.
      (2)   Order the discontinuance of the sale of alcoholic liquor by any wholesaler or retailer.
      (3)   Order the discontinuance of selling, distributing, or giving away of any gasoline or other liquid flammable or combustible products in any container other than a gasoline tank properly affixed to a motor vehicle.
      (4)   Order the discontinuance of selling, distributing, dispensing or giving away of any firearms or ammunition of any character whatsoever.
      (5)   Issue such other orders as are imminently necessary for the protection of life and property.
