§ 75.01 DEFINITIONS.
   For the purpose of this Chapter, and the interpretation and application thereof, the following terms, phrases, words and their derivations shall have the meanings given herein, unless the context in which they are used shall indicate otherwise. When not inconsistent with the context, words used in the present tense include the future, words in the singular number include the plural number and words in the plural number include the singular number. Words or phrases not defined shall be given their common and ordinary meaning unless the context clearly indicates or requires a different meaning.
   (A)   CONTROLLED SUBSTANCE. Any substance as defined and included in the schedules contained in Article II of the Illinois Controlled Substance Act (720 ILCS 570/101, et seq.), as amended from time to time, and cannabis as defined in § 3 of the Cannabis Control Act (720 ILCS 550/3), as amended from time to time.
   (B)   DRUG PARAPHERNALIA. Any equipment, product, and/or materials as defined in § 2 of the Drug Paraphernalia Act (720 ILCS 600/2), as amended from time to time.
   (C)   DRIVING UNDER THE INFLUENCE. Any violation as defined in § 11-501 of the Illinois Vehicle Code (625 ILCS 5/11-501), as amended from time to time.
   (D)   DRIVING WHILE LICENSE, PERMIT OR PRIVILEGE TO OPERATE A MOTOR VEHICLE IS SUSPENDED OR REVOKED. Any violation as defined in § 6-303 of the Illinois Vehicle Code (625 ILCS 5/6-303), as amended from time to time, except a person whose driver's license, permit or privilege to operate a motor vehicle is suspended only for a violation of 625 ILCS 5/13 et seq., "The Emissions Inspection Law", of the Illinois Vehicle Code, as amended.
   (E)   DURING OR AFTER THE COMMISSION OF A FELONY. During or returning from the commission of a felony as defined by Illinois and Federal statute.
   (F)   EXCESSIVE SPEED. A violation of § 11-601.5(b) of the Illinois Vehicle Code (625 ILCS 5/11-601.5(b)), as amended from time to time.
   (G)   OUTSTANDING CRIMINAL WARRANT. Any valid and active criminal warrant.
   (H)   FLEEING AND ELUDING A PEACE OFFICER. Any violation as defined in § 11-204 of the Illinois Vehicle Code (625 ILCS 5/11-204), as amended from time to time.
   (I)   HEARING OFFICER. A licensed attorney who is not an officer or employee of the Village.
   (J)   OPERATION OF A MOTOR VEHICLE WITHOUT A VALID DRIVER'S LICENSE. A violation of § 6-101 and/or § 6-303 of the Illinois Vehicle Code (625 ILCS 5/6-101 and 625 ILCS 5/6-303), as amended from time to time, where the driver's license or driving privileges have been suspended, revoked, canceled, never obtained, or previously had been obtained and have been expired for not less than six (6) months.
   (K)   OWNER OF RECORD. The record titleholder to a motor vehicle.
   (L)   PROSTITUTION OR SOLICITATION. Any violation of § 11-14 of the Criminal Code of 2012 (720 ILCS 5/11-14), as amended from time to time; any violation of § 11-14.1 of the Criminal Code of 2012 (720 ILCS 5/11-14.1), as amended from time to time; any violation of § 11-14.3 of the Criminal Code of 2012 (720 ILCS 5/11-14.3), as amended from time to time; any violation of § 11-14.4 of the Criminal Code of 2012 (720 ILCS 5/11-14.4), as amended from time to time; any violation of § 11-18 of the Criminal Code of 2012 (720 ILCS 5/11-18), as amended from time to time; any violation of § 11-18.1 of the Criminal Code of 2012 (720 ILCS 5/11-18.1), as amended from time to time; or any violation of § 11-26 of the Criminal Code of 2012 (720 ILCS 5/11-26), as amended from time to time.
   (M)   RECKLESS DRIVING OR AGGRAVATED RECKLESS DRIVING. Any violation as defined in § 11-503 of the Illinois Vehicle Code (625 ILCS 5/11-503), as amended from time to time.
   (N)   STOLEN GOODS OR PROPERTY. Any goods or property illegally obtained or not paid for with full consideration.
   (O)   UNDERAGE POSSESSION OF ALCOHOL. The possession of any alcoholic beverage(s) without an individual of legal age being present and in possession of said alcohol or without any exemptions under the law being applicable.
   (P)   UNLAWFUL USE OF WEAPONS. A violation of § 24-1 of the Criminal Code of 1961 (720 ILCS 5/24-1), as amended from time to time.
