The Hearing Officer may, at the request of an inspector, officer, other authorized party on behalf of the Village, or the respondent or his or her attorney, issue subpoenas for the production of records or directing witnesses to appear and give testimony at the hearing. The party requesting a subpoena shall serve, via first class mail, copies of any and all subpoenas on all parties to the action. If, on the date set for hearing, the respondent, his or her attorney or agent, fails to appear, the Hearing Officer may, after determining that proper notice of hearing has given, find the respondent in default and shall proceed with the hearing and accept evidence relevant to the existence of a code violation.
