§ 96.169 PENALTIES FOR MISDEMEANOR.
   (A)   It shall be a misdemeanor for any person, firm or corporation to violate or fail to comply with any of the provisions of this Division.
   (B)   Any person, firm or corporation who violates any provisions of this Division shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each offense; and a separate offense shall be committed for each and every day during or on which a violation occurs or continues to exist.
   (C)   In addition, there may be times when the Village will incur other costs, including third party claims, because the utility or permittee will not or cannot perform its duties under its permit and this Division. Unless the utility shows that another allocation of the cost of undertaking the requested action is appropriate, the utility shall bear the Village's costs of damages and its costs of installing, maintaining, relocating, or removing the facility that is the subject of the permit. No other administrative agency or commission may review or overrule a permit related cost apportionment by the Village Manager. The Village Board may impose sanctions upon a utility that does not pay the costs apportioned to it.
