§ 70.001 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALLEY.  A public way generally giving access to the rear of lots or buildings and not used in general traffic circulation.
   AUTHORIZED EMERGENCY VEHICLES. Police vehicles, vehicles of the Fire Department ambulances and emergency vehicles of municipal departments or public service corporations as are designated or authorized by the Village President and Board of Trustees.
   BICYCLE. Every device propelled by human power upon which any person may ride, having two tandem wheels, either of which is more than 16 inches in diameter.
   COMBINATIONS OF VEHICLES. Any combination of a truck tractor with semitrailer drawing one trailer, and any combination of a truck tractor with semitrailer drawing one trailer, and any combination of a truck in transit drawing two trucks in transit, coupled together by the dual saddle mount method.
   CONTROLLED ACCESS HIGHWAY. Every street or highway in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or from the same, except at the points only as may be determined by the Village President and Board of Trustees or the public authority having jurisdiction over the street or highway.
   CROSSWALK.
      (1)   That portion of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway, measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway.
      (2)   Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface, placed in accordance with the provisions in the manual adopted by the Illinois Department of Transportation, as authorized in ILCS Ch. 625, Act 5, § 11-301.
   DRIVER. Every person who drives or is in actual physical control of a vehicle.
   EXPLOSIVES. Any chemical compound or mechanical mixture that is commonly used or intended for the purpose of producing an explosion and which contains any oxidizing and combustive units or other ingredients in the proportions, quantities or packing that an ignition by fire, by friction, by concussion, by percussion or by detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructible effects on contiguous objects or of destroying life or limb.
   FARM TRACTOR. Every motor vehicle designed and used primarily as a farm implement for drawing wagons, plows, mowing machines and other implements of husbandry, and every implement of husbandry which is self-propelled.
   FLAMMABLE LIQUID. Any liquid which has a flash point of 70° Fahrenheit or less, as determined by a tagliabue or equivalent closed cup test device.
   HANDICAPPED PERSON DECAL. As used in Chapter 71 of this Municipal Code, any insignia, picture, design or the international symbol designating a handicapped person, whether located on a label containing a gold foil hologram made to be transferred (as to glass) from specially prepared paper or on any placard, plaque, vehicle license plate or registration plate issued to a handicapped person (as defined by the Illinois Motor Vehicle Code at ILCS Ch. 625, Act 5, §§ 1-159.1, 3-616 and/or 11-1301.2) or to a disabled veteran (pursuant to ILCS Ch. 625, Act 5, § 3-609) by any State of the United States or any political subdivision thereof.
   IMPLEMENT OF HUSBANDRY. Every vehicle designed and adapted exclusively for agricultural, horticultural or livestock raising operations, including farm wagons, wagon trailers or like vehicles used in connection therewith, or for lifting or carrying an implement of husbandry; provided, no farm wagon, wagon trailer or like vehicle having a capacity of more than 400 bushels or a gross weight of more than 30,000 pounds shall be included hereunder.
   IMPROVED STREET. Any roadway of concrete, brick, asphalt, macadam, crushed stone or gravel.
   INTERSECTION.
      (1)   The area embraced within the prolongation or connection of the lateral curb lines, or, if none, the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles, or the area within which vehicles traveling upon different roadways joining at any other angle may come in conflict.
      (2)   Where a highway includes two roadways 40 feet or more apart, every crossing of each roadway of the divided highway by an intersecting highway shall be regarded as a separate intersection.
      (3)   The junction of an alley with a street or highway does not constitute an intersection.
   LANE CONTROL SIGNAL. An official traffic control device consisting of an electrically controlled and illuminated signal of a square or rectangular design and employing distinctive colors or symbols used to control the direction of vehicular flow on the particular lane to which the indication applies.
   LANED ROADWAY. A roadway which is divided into two or more clearly marked lanes for vehicular traffic.
   MERGING TRAFFIC. A maneuver executed by the drivers of vehicles on converging roadways to permit simultaneous or alternate entry into the junction thereof, wherein the driver of each vehicle involved is required to adjust his or her vehicular speed and lateral position so as to avoid a collision with any other vehicle.
   METAL TIRE. Every tire, the surface of which in contact with the highway is wholly or partly of metal or other hard, non-resilient material.
   MOTOR VEHICLE. Every vehicle which is self-propelled and every vehicle which is propelled by electric power, obtained from overhead trolley wires, but not operated upon rails. For the purposes of this chapter, MOTOR VEHICLES as a class shall be divided into two divisions:
      (A)   First division. Those vehicles which are designed and used for the carrying of not more than ten persons.
      (B)   Second division. Those vehicles which are designed and used for pulling or carrying freight and also those vehicles or motor cars which are designed and used for the carrying of more than ten persons.
   MOTORCYCLE. Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground but excluding a tractor.
   OFFICIAL TRAFFIC CONTROL DEVICES. All signs, signals, markings and devices which conform with the state manual and not inconsistent with this chapter, placed or erected by authority of the Village President and Board of Trustees for the purpose of regulating, warning or guiding traffic.
   OWNER. A person who holds the legal title of a vehicle. In the event a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event of a mortgagor of a vehicle is entitled to possession, the conditional vendee, lessee or mortgagor shall be deemed the OWNER for the purposes of this chapter.
   PARK or PARKING. When prohibited, means the standing of a vehicle, whether occupied or not, otherwise than when temporarily or actually engaged in loading or unloading merchandise or passengers.
   PEDESTRIAN. Any person afoot.
   PNEUMATIC TIRE. Every tire in which compressed air is designed to support the load.
   POLICE OFFICER. Every officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
   PRIVATE ROAD or DRIVEWAY. Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner but not by other persons.
   RAILROAD. A carrier of persons or property upon cars, other than street cars, operated upon stationary rails.
   RAILROAD SIGNS or SIGNALS. Any sign, signal or device other than an official traffic control device, erected in accordance with the laws governing the same and intended to give notice of the presence of railroad tracks or the approach of a railroad train.
   RAILROAD TRAIN. A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars.
   REVERSIBLE LANE. A lane of a two- or more laned roadway, upon which traffic may be directed to move in either direction by means of lane-controlled signals or other devices in conjunction with official signs.
   RIGHT-OF-WAY. The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under the circumstances of direction, speed and proximity as to give rise to danger of collision, unless one grants precedence to the other.
   ROAD TRACTOR. Every motor vehicle designed and used for drawing other vehicles and not constructed so as to carry any load thereon either independently or any part of the weight of a vehicle or load so drawn.
   ROADWAY. That portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a highway includes two or more separate ROADWAYS, the term as used herein shall refer to any such ROADWAY separately but not to all the ROADWAYS collectively.
   SAFETY ZONE. The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times, while set apart as a SAFETY ZONE.
   SCHOOL BUS. Every motor vehicle of the second division owned or operated by and for a public or governmental agency or by or for a private or religious organization for the transportation of pupils in connection with any school activity. This definition does not include a bus operated by a public utility or a municipal corporation authorized to conduct local or inter-urban transportation of passengers.
   SEMITRAILER. Every vehicle without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
   SIDEWALK. That portion of a street between the curb lines or the lateral lines of a roadway and the adjacent property lines intended for the use of pedestrians.
   SOLID TIRE. Every tire of rubber or other resilient material which does not depend upon compressed air for the support of the load.
   STOP. When required, STOP means complete cessation from movement.
   STOP or STOPPING. When prohibited, means any halting of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal.
   STREET or HIGHWAY. The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular traffic.
   THROUGH HIGHWAY. Every highway or portion thereof on which vehicular traffic is given preferential right-of-way and at the entrance to which vehicular traffic from intersecting highways is required by law to yield right-of-way to vehicles on the THROUGH HIGHWAY in obedience to either a stop sign or a yield sign, when the signs are erected as provided in this chapter.
   TRAFFIC. Pedestrians, ridden or herded animals, vehicles, streetcars and other conveyances, either singly or together, while using any street or highway for purposes of travel.
   TRAFFIC CONTROL SIGNAL. Any official traffic control device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and permitted to proceed.
   TRAILER. Every vehicle without motive power in operation, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle.
   TRUCK TRACTOR. Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load, other than a part of the weight of the vehicle and load so drawn.
   VEHICLE. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
   YIELD RIGHT-OF-WAY. When required by an official sign, means the act of granting the privilege of the immediate use of the intersecting roadway to traffic within the intersection and to vehicles approaching from the right or left, provided that when the roadway is clear, any vehicle approaching the sign may proceed into the intersection.
