§ 51.61 WHEN LICENSE TO BE ISSUED; PUBLIC HEARING.
   (A)   No license or permit to conduct a landfill operation within the Village or within one mile of the Village limits shall be issued unless all pertinent laws, statutes and ordinances of the United States, the state of Illinois and the Village have been complied with and a public hearing has been conducted, as hereinafter provided.
   (B)   The Zoning, Planning, and Appeals Com- mission shall hold a public hearing, after giving due notice thereof, on the question of whether such a permit should be issued. A transcript of this hearing shall be transmitted to the Board of Trustees.
   (C)   The Zoning, Planning, and Appeals Com- mission shall submit its report and recommendations to the Board of Trustees, including the above- mentioned transcript, stating reasons why it recommends the applications be granted or denied, and shall send a copy thereof to the applicant. The Board then shall consider the reports and recommendations so transmitted by the Commission and, if the Board finds public convenience and necessity as well as the public health and general welfare of the people of the Village will not be injured, shall issue a permit to the applicant; otherwise, the application shall be denied and the applicant shall be so informed.
