§ 34.163 JURISDICTION AND PURPOSE.
   The Commission shall have the following functions:
   (A)   To prepare and recommend to the President and Board of Trustees of the Village of Schiller Park adoption of a Comprehensive Plan and/or any amendment(s) thereto for the present and future development or redevelopment of the Village of Schiller Park.
      (1)   Such plan may be adopted in whole or in separate geographical or functional parts, each of which, when adopted by the President and Board of Trustees, shall be the Official Comprehensive Plan, or part thereof, of the Village of Schiller Park.
      (2)   This Plan may include reasonable requirements with reference to streets, alleys, public grounds, and other public improvements.
      (3)   The Plan by its very terms may be made applicable to land situated within the corporate limits of the Village of Schiller Park and contiguous territory not more than 1-1/2 miles beyond the corporate limits, but not included within the corporate limits of the Village of Schiller Park.
      (4)   The Official Comprehensive Plan may establish reasonable standards of design for subdi- vision or resubdivision of unimproved land and of areas subject to redevelopment in respect to public improvements.
      (5)   The Official Comprehensive Plan may establish reasonable requirements governing the location, width, course, and surfacing of public streets and highways, alleys, ways for public service facilities, curbs, gutters, sidewalks, street lights, parks, playgrounds, school grounds, size of lots to be used for residential purposes, storm water drainage, water supply and distribution, sanitary sewers, and sewage collection and treatment.
      (6)   The Official Comprehensive Plan may designate land suitable for annexation to the Village of Schiller Park, along with recommended zoning classification for such land upon annexation.
      (7)   Such Official Comprehensive Plan shall be advisory and in and of itself shall not be construed to regulate or control the use of private property in any way, except as to such part of the said plan as has been implemented by ordinances duly enacted by the President and Board of Trustees of the Village of Schiller Park.
      (8)   Said Official Comprehensive Plan and the ordinance implementing same shall be placed on file with the Village Clerk and shall be available at all times during regular business hours for public inspection.
      (9)   Copies of said Official Comprehensive Plan, all ordinances implementing same, and the official map shall be available to all interested parties upon payment by said parties of a fee therefor as established from time to time by the President and Board of Trustees, in order to reimburse the general fund of the Village of Schiller Park for the cost of printing and distributing same.
      (10)    No Comprehensive Plan or amendment thereto shall be adopted and made official by the President and Board of Trustees of the Village of Schiller Park that has not been submitted to the Commission.
         (a)   Upon submission by the President and Board of Trustees of the Village of Schiller Park of any suggested Comprehensive Plan, part thereof, or amendment to an existing Comprehensive Plan to the Plan Commission for consideration and recommendation, the President and Board of Trustees of the Village of Schiller Park may require a report thereon from the Commission with its recommendation within 90 days from the date of such submission.
         (b)   If the Commission shall fail to make such report within the said 90 days, then the President and Board of Trustees of the Village of Schiller Park may proceed to consider for adoption such Comprehensive Plan, or part thereof, or an amendment to an existing Official Comprehensive Plan, including arranging for and holding a public hearing thereon in accordance with the provisions hereinafter contained in the same manner as if the Commission had made its recommendation.
      (11)    Upon submission of a Comprehensive Plan by the Commission, or the submission of a proposed amendment to an existing Official Comprehensive Plan, the President and Board of Trustees of the Village of Schiller Park shall schedule a public hearing thereon to be held at a meeting of the Zoning, Planning, and Appeals Commission which shall forward its written recommendation to the President and Board of Trustees within 30 days after the conclusion of said public hearing.
         (a)   Not less than 15 days' notice of the proposed hearings, and the time and date and place thereof, shall be given by publication in a newspaper of general circulation in the County of Cook, in which the Village of Schiller Park and contiguous unincorporated areas are located.
         (b)   The hearing shall be informal, but all persons desiring to be heard in support of or opposed to the Comprehensive Plan or amendment shall be afforded such opportunity to be heard and may submit their statements orally or in writing.
         (c)   The hearing may be recessed to another date if not concluded, provided that notice of the time and place thereof is publicly announced at the hearing at the time of such recess or notice is given by newspaper publication not less than five days prior to the recessed hearing.
      (12)   Within 90 days after the conclusion of the final hearing, the President and Board of Trustees of the Village of Schiller Park, after consideration of the recommendations of the Commission and of such information as shall have been derived from the hearing, shall either adopt the Comprehensive Plan or amendment in whole or in part, or reject the entire Comprehensive Plan or amendment in whole or in part, or reject the entire Comprehensive Plan or amendment.
         (a)   If adopted, such adoption shall be by ordinance enacted by the President and Board of Trustees, which ordinance shall include a map or maps drawn to scale, reasonably accurate, showing north point and section lines and numbers, and consisting of the whole area included within the Official Comprehensive Plan or, if an amendment, one or more separate geographical or functional parts, and all of any part of the contiguous unincorporated area within 1-1/2 miles from the corporate limits of the Village.
         (b)   If, at the expiration of such 90 days, the President and Board of Trustees of the Village of Schiller Park have taken no formal action, the Comprehensive Plan or amendment thereto may thereafter not be acted upon by the said President and Board of Trustees without again complying with the provisions of notice and hearing heretofore provided.
         (c)   The Comprehensive Plan or amendment, if approved and adopted, shall become effective upon the expiration of ten days after the date of adoption of the ordinance implementing the Official Comprehensive Plan or amendment.
   (B)   To recommend changes, from time to time, in the Official Comprehensive Plan.
   (C)   To prepare and recommend to the President and Board of Trustees of the Village of Schiller Park, from time to time, suggestions for improvements in pursuance of the official Comprehensive Plan, including a plan to implement the proper residential development and economic balance within the corporate limits of the Village of Schiller Park.
   (D)   To review and recommend the denial or the approval of plats of subdivision.
      (1)   Following the adopting of an official Comprehensive Plan in the manner prescribed in the Zoning Ordinance, no map or plat of any subdivision or resubdivision presented for record, affecting land within the corporate limits of the Village of Schiller Park or contiguous territory outside of but not more distant than 1-1/2 miles from such limits of the Village of Schiller Park, shall be entitled to record or shall be valid unless the subdivision thereon shall meet the subdivision regulations of the Village of Schiller Park and otherwise conform to any requirements thereto shown in the official Comprehensive Plan of the Village of Schiller Park.
      (2)   The procedures for review of such maps or plats of subdivision shall be as established within the subdivision regulations of the Village of Schiller Park.
   (E)   To hold public hearings on requests for amendments to the Zoning Ordinance, to make and to forward findings of fact and recommendations thereon to the President and Board of Trustees.
      (1)   The regulations imposed and the districts created by the Zoning Ordinance may be amended from time to time by ordinance after the ordinance establishing same has gone into effect, but no amendments shall be made without a hearing before the Commission.
      (2)   All applications for amendment to this subchapter shall be filed with the Secretary in such form and accompanied by such information as required by the Commission and shall include a disclosure of beneficial interests. In the case of applications to amend the Zoning Map, such applications shall be filed by the legal or beneficial owner of the property for which an amendment is sought. All such applications shall be forwarded to the Commission at the Commission's next available agenda after all required notices have been provided in accordance with state statutes and Village ordinances.
   (F)   To hear all applications for special use permits and/or conditional use permits and submit its recommendations thereon to the President and Board of Trustees of the Village of Schiller Park.
   (G)   To prepare and recommend to the President and Board of Trustees of the Village of Schiller Park schemes for regulating or forbidding structures or activities which may hinder access to solar energy necessary for the proper functioning of solar energy systems, as defined in Section 1.2 of the Comprehensive Solar Energy Act of 1977, or to recommend changes in such schemes.
   (H)   To hear all applications for variations from the regulations and restrictions contained in the Zoning Ordinance and to submit its recommendations thereon to the President and Board of Trustees of the Village of Schiller Park.
      (1)   To hear appeals from any order, requirement, decision or determination made by the Zoning Administrator in the administration or enforcement of this subchapter and/or any other ordinance of the Village of Schiller Park upon which the Commission is required to pass and to submit its recommendation thereon to the President and Board of Trustees of the Village of Schiller Park.
   (I)   To hear and decide, or make recommen- dations on such other matters as may from time to time be committed to its jurisdiction by the President and Board of Trustees of the Village of Schiller Park.
