§ 34.162 MEETINGS AND HEARINGS OF THE COMMISSION.
   (A)   All hearings and all meetings of the Commission shall be open to the public, and the records and minutes thereof shall be available for examination in the office of the Village Clerk during regular business hours. At hearings and meetings of the Commission, any interested person may appear or may be represented by duly authorized agents or attorneys.
   (B)   All regular meetings of the Commission shall be held on the second Wednesday of each month beginning in the month of June 2017 at the hour of 7:00 p.m., provided that when a day fixed for any regular meeting of the Commission falls on a day designated by law as a legal or national holiday, no meeting shall be held.
      (1)   The Commission shall keep minutes of its meetings showing the vote of each member upon every question, or if absent or if failing to vote, indicating that fact.
      (2)   The concurring vote of a majority of the members of the Commission present at any meeting shall be necessary to make any recommendations to the President and Board of Trustees.
   (C)   All special meetings of the Commission shall be held at the call of the Chairman and at such other times as the Commission shall determine.
   (D)   No testimony shall be taken and no witness heard on any appeal, variation, and/or zoning application except at a properly convened hearing of the Commission. All testimony at hearings before the Commission shall be given under oath and a record of a court reporter provided for each such hearing by the petitioner therein.
      (1)   The Chairman, or in his absence the Vice-Chairman, shall administer or authorize the administration of oaths and may compel the attendance of witnesses, and shall otherwise have such similar authority as the Chairman and/or acting chairman of a board of appeals in the general law.
      (2)   No vote upon any recommendation of the Commission shall be had at any hearing unless the Commission shall by rule provide that such hearing shall be deemed a meeting and the regulations concerning quorum and maintenance of minutes shall have been adhered to.
      (3)   The petitioner shall reimburse the Village for two certified copies of the official court reporter's transcript of such hearing(s), which shall thereafter be maintained by the Village Clerk as part of the official record.
      (4)   Each application filed with the Commission for zoning consideration shall be accompanied by the following filing fees:
         (a)   An application fee equal to $300 for hearings held during regular meetings of the Commission;
         (b)   An application fee equal to $300 for hearings held during special meetings of the Commission; and
      (5)   The Village Clerk is authorized hereby to make such additional charges as may be necessary to reimburse the Village for the actual cost of court reporter fees and the mailing of notices whenever the filing fees authorized to be collected herein are insufficient to cover the cost of such public hearing. The amount of such additional charges shall be paid the Village by the petitioner within ten days of receipt of the invoice therefor from the Village.
