(A) Appointment and Vacancies. The Zoning, Planning, and Appeals Commission (in this section hereinafter referred to as “Commission”) shall consist of a Chairman and eight other members appointed by the Village President with the approval of the President and Board of Trustees. All members of the Commission shall be residents of the Village of Schiller Park.
(1) In appointing the members of the Commission, the Village President shall designate the Chairman thereof, and upon initial appointment three members shall be appointed for the period ending at 11:59 p.m. on April 30, 1996; three members shall be appointed for the period ending at 11:59 p.m. on April 30, 1997; and three members shall be appointed for the period ending at 11:59 p.m. on April 30, 1998. Thereafter each member shall serve for a three year term and until his successor has been appointed. Vacancies upon the Commission shall be filled for the unexpired term of the member whose place has become vacant. The Zoning Administrator and the Director of Community Development shall serve as nonvoting ex officio members of the Zoning, Planning and Appeals Commission.
(2) The Village President shall have the power to remove any member of the Commission at any time for cause. In the event a member desires to appeal his removal, such member shall file with the Village Clerk a request for a public hearing before the President and Board of Trustees. In the event of such request, following the public hearing, the President and Board of Trustees may affirm or reverse the decision of the Village President.
(3) The office of any Commission member who fails to attend three consecutive Commission meetings without a valid reason, or who fails to attend one half of the total of all Commission meetings scheduled or called during any one year period, may be declared vacant by a majority vote of the remaining members of the Commission. Upon his receipt of notice of declaration of vacancy from the Commission, or in the event a vacancy in any office of a member of the Commission occurs for any reason, with the advice and consent of the President and Board of Trustees of the Village, the Village President shall appoint a successor to fill the unexpired term of office created by the vacancy.
(B) Secretary. The Director of Community Development shall act ex officio as the Secretary of the Commission and shall be responsible for all of the correspondence, minutes, and records of the Commission. The Secretary shall not be a member of the Commission.
(1) The Secretary of the Commission shall be responsible for filing the most current rules and procedures or bylaws of the Commission, the minutes of meetings, the record of hearings, and other documents and recommendations with the Village Clerk and copies thereof with the Building Official.
(2) The Secretary shall perform such other duties as may be assigned from time to time by the Commission.
(3) The Secretary may be given such clerical assistance as the President and Board of Trustees may provide.
(C) Vice-Chairman. Upon initial appointment, one of the eight members of the Commission shall be appointed by the Village President to serve as Vice- Chairman for one year. Thereafter, no later than its first regular meeting following May 1 of each year, the Commission shall choose from among its members a Vice- Chairman, who shall undertake the duties of Chairman in the absence of the Chairman from any meetings of the Commission.
(D) Chairman. The Chairman, or in his absence the Vice- Chairman, shall supervise the affairs of the Commission. The Chairman shall also act ex officio as a member of the Design Review Committee.
(E) Compensation. The compensation paid to the members of the Zoning, Planning, and Appeals Commission shall be as established from time to time by the President and Board of Trustees.
