For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
LOTTERY. The numbers game, policy and similar types of wagering. The term does not include:
(1) Any game of a type in which usually the wagers are placed, the winners are determined and the distribution of prizes or other property is made in the presence of all persons placing wagers in the game; and,
(2) Drawings conducted by an organization exempt from taxes under 25 USC 101, if no part of the net proceeds derived from the drawings inures to the benefit of any private shareholder or individual.
SLOT MACHINE. A device which operates by means of the insertion of a coin, token or similar object and which, by application of the element of chance, may deliver or entitle the person playing or operating the device to receive cash, premiums, merchandise or tokens, including a coin-in-the-slot operated mechanical pinball device played for amusement which rewards the player with the right to replay the mechanical device.
WAGER. Any wager with respect to a sports event or a contest, placed with a person engaged in the business of accepting such wagers; any wager placed in a wagering pool with respect to a sports event or a contest, if the pool is conducted for profit; and any wager placed in a lottery conducted for profit.
