a. There is hereby established the Town HIDTA Administrative Revenue Fee Special Non-Reverting Fund, which shall be a special non-reverting fund under the rules, regulations and requirements of applicable Indiana Law, including the Indiana Code, as amended from time to time, as well as the administrative rules and requirements of the Indiana State Board of Accounts.
b. The administration fee paid and distributed to the Town, as the fiduciary agent and sponsoring agency for the Lake County, Indiana High Intensity Drug Trafficking Area (HIDTA) Program, as the same is paid and received by the Town, shall be deposited into the HIDTA Administrative Revenue Fee Special Non-Reverting Fund.
c. The administrative fee paid by the ONDCP to the Town pursuant to the Town's Fiduciary Agreement with the Lake County, Indiana HIDTA Executive Board shall be deposited into the HIDTA Administrative Revenue Fee Special Non-Reverting Fund, and said administrative fee shall be utilized and expended as determined appropriate and authorized by the Town Council, consistent with the applicable rules, regulations and requirements of applicable Indiana Law, including the Indiana Code, as amended from time to time, as well as the administrative rules and requirements of the Indiana State Board of Accounts.
d. The Clerk-Treasurer of the Town is authorized and directed to take all appropriate and required steps to establish the HIDTA Administrative Revenue Fee Special Non-Reverting Fund in conformance and compliance with all applicable law, as amended from time to time, as set forth.
e. The HIDTA Administrative Revenue Fee Special Non-Reverting Fund shall be established and shall exist as long as the Town continues to act as the fiduciary agent and sponsoring agency for the Lake County, Indiana, High Intensity Drug Trafficking Area (HIDTA) Program pursuant to its approved Fiduciary Agreement. In the event that the Lake County, Indiana HIDTA Program is terminated, or the Town does not continue to act as the fiduciary agent and sponsoring agency for the Lake County, Indiana HIDTA Program, then upon payment of all valid and proper expenses required and authorized by the Town Council to be paid and made from the HIDTA Administrative Revenue Fee Special Non-Reverting Fund, the special non-reverting fund shall be closed, and all funds remaining, if any, shall be transferred to the fund or funds authorized and approved by the Town Council for transfer of same.
