3-2-5: PENALTY; ABATEMENT PROCEDURES:
   A.   Fine: Any person, firm or corporation found guilty of violating the provisions of this chapter shall be fined not less than fifty dollars ($50.00) nor more than seven hundred fifty dollars ($750.00) for each offense. Each person, firm or corporation shall be deemed guilty of a separate offense for each and every day during which any violation of any of the provisions of this chapter are continued.
   B.   Abatement By Village; Costs A Lien: In addition to the foregoing, the village may abate the nuisance in any reasonable manner and may collect from such violators the reasonable cost thereof. The cost of removal shall become a lien on the real estate affected; provided, that a notice of lien is filed in the office of the county recorder of deeds within sixty (60) days of the completion of the abatement of said nuisance. The lien notice shall set forth a description of the real estate involved, the amount of money representing the costs and expenses incurred in the abatement of the nuisance, and the dates when said costs and expenses were incurred by the village.    C.   Recovery Of Costs: In addition to the foregoing, the village attorney is authorized and directed to initiate litigation in court to recover the costs incurred in abating the nuisance. (Ord., 5-28-2002)
