A. The Village of Scales Mound, pursuant to its authority under 65 ILCS 5/1-2.2 et seq., hereby establishes the procedure for a system of local adjudication of Village code violations to the extent permitted by the Illinois Constitution.
B. As used in this chapter, a “system of local adjudication” means the adjudication of any violation of the Village of Scales Mound Code through the establishment of a code hearing department except for (i) building code violations and (ii) any offense under the Illinois Vehicle Code or similar offense that is a traffic regulation governing the movement of vehicles or a reportable offense under section 6-204 of the Illinois Vehicle Code (625 ILCS 5/6-204) (hereinafter “local adjudication”).
C. This chapter is intended to comply with 65 ILCS 5/1-2.2 et seq. and where there is any conflict or missing information, 65 ILCS 5/1-2.2 et seq. shall supersede this chapter.
D. To accomplish the purposes set forth herein, the Illinois Vehicle Code (625 ILCS 5/11-208.3 et seq.) is adopted in its current form and as it may be amended from time to time for adjudication of vehicular regulation violations to the extent permitted by the state constitution.
E. The process for local adjudication may be consolidated and organized in conjunction with Seizure and Impoundment of Vehicles Ordinance of the Village of Scales Mound.
F. The process for local adjudication may be consolidated and organized in conjunction with the process for building code and nuisance administrative adjudication provided in Chapters 1 through 5 of Title 2, Chapters 1 through 7 of Title 3, Chapters 1 through 6 of Title 4, Chapters 1 through 3 of title 5, Chapters 1 through 2 of Title 6, Chapters 1 through 3 of Title 7, Chapters 1 through 14 of Title 8, and Chapters 1 through 4 of Title 9 of the Village of Scales Mound Code.
