2-4-5: POWERS, DUTIES AND JURISDICTION IN ITS ZONING CAPACITY:
The PZB is hereby vested with the following powers, duties, jurisdiction and authority related to its zoning role:
   (A)   The PZB shall hear and decide appeals from and review any order, requirement, decision or determination made by the administrative official charged with the enforcement of the zoning title. It shall also hear and decide all matters referred to it or upon which it is required to pass under the zoning title. The concurring vote of four (4) members of the board shall be necessary to reverse any order, requirement, decision or determination of such administrative official or to decide in favor of the applicant regarding any matter upon which it is required to pass under the zoning title, or to recommend any variation or modification in the zoning title. Every such recommendation by the board after a hearing shall be accompanied by a finding of fact, specifying the reason for such recommendations.
   (B)   The PZB shall also hear all applications for variations to the provisions of the zoning title, and shall submit to the city council its recommendations, based on a finding of fact, for enactment of an amending ordinance, as the city council sees fit. In making recommendations to the city council, the board shall find that a proposed variation will not contaminate the air, nor impair the light supply to adjacent property, increase the congestion in the public streets, increase the danger of fire, impair or diminish property values or be contrary to the general health, safety and welfare of the people of the city. The city council shall not authorize a variation until a public hearing has been held by the board pursuant to notice, and until the board's recommendation with such a finding of the fact has been received by the city council.
