10-1-4: DEFINITIONS:
ABUTS, ABUTTING: Having a common property line or district line.
ACCESSORY BUILDING: A detached subordinate building or a portion of a principal building, the use of which is incidental to that of the dominant use of the principal building.
ACCESSORY USE: See definition of Use, Accessory.
ADJACENT: To lie near or close to; in the neighborhood or vicinity of.
ADJOINING: Touching or contiguous, as distinguished from lying near or adjacent.
AIRPORT: Any area of land which is used, or intended for use, for the landing and takeoff of aircraft; and any appurtenant areas which are used or intended for use as airport buildings or other airport structures or rights of way, together with all airport buildings and structures located thereon.
ALLEY: Any right of way, with a width of not less than sixteen feet (16') nor more than twenty four feet (24'), which affords a secondary means of vehicular access to abutting properties. A street shall not be considered an alley.
ALTERATION: Any change in size, shape, occupancy or use of a building or structure.
ANIMAL HOSPITAL: A building or portion thereof designed or used for the care, observation, or treatment of domestic animals.
AUTOMOBILE LAUNDRY: A building or portion thereof containing facilities for washing more than two (2) motor vehicles, using production line methods.
AUTOMOBILE SERVICE STATION: Any building or portion thereof, structure and premises used for dispensing or offering for sale at retail to the public or motor vehicle fuels stored on the premises; and where lubricating oil and grease, tires, batteries and similar accessories and parts also may be offered for sale. When such dispensing, sale, or offering for sale is incidental to the conduct of a public garage, the premises are classified as a public garage. Automobile service stations do not include open sales lots.
AUTOMOBILE WRECKING YARD: See definition of Junkyard.
AWNING: A roof like mechanism, retractable in operation, and covered with flexible, textured materials, which projects from the wall of a building.
BASEMENT: A story having part, but not more than one-half (1/2), of its floor to clear ceiling height below grade. When a basement is used for storage, garages for use of occupants of the building, or other utilities common for the rest of the building, it shall not be counted as a story.
BLOCK: A tract of land bounded by streets, or by a combination of streets and public parks, railroad rights of way, or other similar natural boundaries. A block may be located in part beyond the boundary lines of the corporate limits of the city.
BOARDING HOUSE: See definition of Lodging House.
BUILDABLE AREA, FOR THE PURPOSE OF MEASURING LOT WIDTH: The narrowest width within the thirty feet (30') of lot depth immediately in back of the front yard line.
BUILDING: Any structure having a roof supported by columns or walls, designed or intended for the support, enclosure, shelter, or protection of persons, animals, chattels, or property of any kind, and which is permanently affixed to the land. When such building is divided by a part wall or walls, each portion of the building shall be considered a separate building.
BUILDING, ACCESSORY: See definition of Accessory Building.
BUILDING, COMPLETELY ENCLOSED: The words "completely enclosed building" mean a building separated on all sides from the adjacent open space, or from other buildings or structures, by a permanent roof and by exterior walls or party walls.
BUILDING, DETACHED: The words "detached building" mean a building surrounded by open space.
BUILDING, HEIGHT OF: The words "height of building" mean the vertical distance from the grade to the highest point of the coping of a flat roof or to the deck line of a mansard roof, or to the mean height level between eaves and ridge for gable, hip or gambrel roofs; chimneys, towers, spires, elevator penthouses, cooling towers, and similar projections other than signs shall not be included in calculating building height.
BUILDING INSPECTOR: The official of the city of Savanna who has been duly appointed by the city council.
BUILDING, PRINCIPAL: The words "principal building" mean a nonaccessory building in which is conducted the principal use of the lot.
BUILDING, TEMPORARY: The words "temporary building" mean any building not designed to be permanently located at the place where it is, or where it is intended to be temporarily placed or affixed.
BULK: The term used to indicate the size and setback of buildings or structures, and the location of same with respect to one another, and includes the following:
(A) Size and height of buildings,
(B) Location of exterior walls at all levels in relation to lot lines, streets, or to other buildings,
(C) Floor area ratio,
(D) All open space allocated to buildings; and
(E) Amount of lot area and lot width provided per dwelling unit.
BUSINESS: Any gainful occupation, employment, or enterprise which occupies time, attention, labor and materials; and where merchandise is exhibited and sold or offered for sale, or where services are offered.
CANNABIS BUSINESS ESTABLISHMENT: A cultivation center, craft grower, processing organization, dispensing organization, or transporting organization as defined and regulated by Public Act 101-0027, Cannabis Use and Tax Act.
CAPACITY IN PERSONS: The maximum number of persons that can avail themselves of the services (or goods) of an establishment or use at any time, with reasonable comfort and safety.
CARPORT: A roofed automobile shelter, with one or more open sides.
CELLAR: A story having more than one-half (1/2) of its floor to clear ceiling height below grade. A cellar is not included in computing the number of stories for the purpose of height measurement.
CITY COUNCIL: The mayor and city council of the city of Savanna.
CLINIC, MEDICAL OR DENTAL: The words "medical or dental clinic" mean a building or portion thereof, the principal use of which is for offices of an organization or group practice of specializing physicians or dentists, or both, and contains facilities for examination and treatment of patients but without facilities for overnight lodging.
CLUB OR LODGE, PRIVATE: The words "private club or lodge" mean a nonprofit association of persons who are bona fide members and whose facilities and guests are restricted.
CONFORMING BUILDING OR STRUCTURE: Any building or structure which:
(A) Complies with all the regulations of this title or of any amendment thereto governing bulk of the district in which said building or structure is located; or
(B) Is designed or intended for a permitted or special use as applicable in the district in which it is located.
CONTIGUOUS: In actual contract.
COURT: An open unoccupied space other than a yard on the same lot with a building or group of buildings and which is bounded on two (2) or more sides by such building or buildings.
CRAFT GROWER: A facility operated by an organization or business that is licensed by the Department of Agriculture to cultivate, dry, cure, and package cannabis and perform other necessary activities to make cannabis available for sale at a dispensing organization or use at a processing organization. A craft grower may contain up to five thousand (5,000) square feet of canopy space on its premises for plants in the flowering state. The Department of Agriculture may authorize an increase or decrease of flowering stage cultivation space in increments of three thousand (3,000) square feet by rule based on market need, craft grower capacity, and the licensee's history of compliance or noncompliance, with a maximum space of fourteen thousand (14,000) square feet for cultivating plants in the flowering stage, which must be cultivated in all stages of growth in an enclosed and secure area. A craft grower may share premises with a processing organization or a dispensing organization, or both, provided each licensee stores currency and cannabis or cannabis-infused products in a separate secured vault to which the other licensee does not have access or all licensees sharing a vault share more than fifty percent (50%) of the same ownership.
CULTIVATION CENTER: A facility operated by an organization or business that is licensed by the Department of Agriculture to cultivate, process, transport (unless otherwise limited by this Act), and perform other necessary activities to provide cannabis and cannabis-infused products to cannabis business establishments.
DISPENSING ORGANIZATION: A facility operated by an organization or business that is licensed by the Department of Financial and Professional Regulation to acquire cannabis from a cultivation center, craft grower, processing organization, or another dispensary for the purpose of selling or dispensing cannabis, cannabis-infused products, cannabis seeds, paraphernalia, or related supplies under this Act to purchasers or to qualified registered medical cannabis patients and caregivers. As used in this Act, "dispensary organization" shall include a registered medical cannabis organization as defined in the Compassionate Use of Medical Cannabis Pilot Program Act or its successor Act that has obtained an Early Approval Adult Use Dispensing Organization License.
DISTRICT: A portion of the corporate area of the city of Savanna, as designated on the zoning district map, within which certain uniform regulations and requirements, or various combinations thereof, apply under the provisions of this title.
DOMESTIC PET SERVICE: An establishment where clipping, bathing, and other services except that of a veterinary nature are rendered to dogs, cats and domestic pets. No boarding shall be permitted.
DRIVE-IN ESTABLISHMENT: An establishment or part thereof in which are provided facilities where serving or consuming commodities, or both, are intended to occur primarily in patrons' automobiles on the premises.
DWELLING: A building or portion thereof designed or used exclusively for residential purposes, including single-family, two-family, and multiple-family dwellings, but not including lodging rooms in hotels, motels or lodging houses.
DWELLING, ATTACHED: The words "attached dwelling" mean a dwelling joined to two (2) other dwellings, by party walls, or cavity walls, and aboveground, physically unifying, horizontal, structural elements.
DWELLING, DETACHED: The words "detached dwelling" mean a dwelling which is surrounded on all sides by open space on the same lot.
DWELLING, MULTIPLE-FAMILY: The words "multiple-family dwelling" mean a building containing three (3) or more units.
DWELLING, SEMIDETACHED: The words "semidetached dwelling" mean a dwelling joined to one other dwelling by a party wall, or cavity wall, and other aboveground, physically unifying, horizontal, structural element.
DWELLING, SINGLE-FAMILY: The words "single-family dwelling" mean a building containing one dwelling unit only.
DWELLING, TWO-FAMILY: The words "two-family dwelling" mean a building containing two (2) dwelling units only, one above the other.
DWELLING UNIT: One or more rooms which are arranged, designed, or used as living quarters for one family only. Individual bathroom and complete single kitchen facilities, permanently installed to serve the entire family, shall always be included within each "dwelling unit".
EFFICIENCY UNIT: A dwelling unit consisting of one principal room, exclusive of bathroom, kitchen, hallway, closets, or dining room, exclusive of bathroom, kitchen, hallway, closets, or dining alcove directly off the principal room providing that such dining alcove does not exceed ninety (90) square feet in area.
ELECTRIC DISTRIBUTION CENTER: A terminal at which electric energy is received from the transmission system and is delivered to the distribution system only.
ELECTRIC SUBSTATION: A terminal at which electric energy is received from the transmission system and is delivered to other elements of the transmission system and, generally, to the local distribution system.
ENGINEER, CITY: The words "city engineer" mean the official of the city of Savanna, duly appointed and designated as the city engineer.
ESTABLISHMENT, BUSINESS: The words "business establishment" mean a place of business carrying on an operation, the ownership or management of which is separate and distinct from those of any other place of business located on the same or other lot.
FALLOUT SHELTER: An accessory building and use which incorporates the fundamentals for fallout protection, shielding mass, ventilation, and space to live, and which is constructed of such materials, in such a manner, as to afford to the occupants substantial protection from radioactive fallout.
FAMILY: One person or two (2) or more persons each related to the other by blood, marriage, or legal adoption, or a group of not more than three (3) persons not all so related, together with his or their domestic servants, maintaining a common household in a dwelling unit. A family may include, in addition thereto, not more than two (2) roomers, boarders, or permanent guests, whether or not gratuitous.
FENCE: A structure, or tree or shrub hedge which is a barrier and used as a boundary or means of protection or confinement.
FENCE, OPEN: The words "open fence" mean a fence including gates which is designed in a manner that allows the flow of air through the fence, extending over the entire length and height of the fence.
FENCE, SOLID: The words "solid fence" mean a fence, including gates, which conceals from view from adjoining properties, streets, or alleys, activities conducted behind it.
FLOOD CREST ELEVATION: The elevation of the established flood level as designated by the city engineer of Savanna.
FLOODPLAIN AREA: That continuous area of land adjacent to a stream or streambed, or any stormwater retention area and its tributaries, having an elevation equal to or lower than flood crest elevation, including also land less than ten (10) acres in area having an elevation higher than flood crest elevation and which is completely surrounded by land in a "floodplain area".
FLOOR AREA, FOR DETERMINING FLOOR AREA RATIO: The sum of the gross horizontal areas of the several floors including also the basement floor of a building, measured from the exterior faces of the exterior walls, or from the centerlines of walls separating two (2) buildings. The floor area shall also include the horizontal areas on each floor devoted to:
(A) Elevator shafts and stairwells;
(B) Mechanical equipment, except if located on the roof, when either open or enclosed, i.e., bulkheads, water tanks, and cooling towers;
(C) Habitable attic space as permitted by the building codes of the city of Savanna;
(D) Interior balconies and mezzanines;
(E) Enclosed porches; and
(F) Accessory uses.
The "floor area" of structures used for bulk storage of materials, i.e., grain elevators, petroleum tanks, shall also be included in the "floor area" and such "floor area" shall be determined on the basis of the height of such structures with one floor for each ten feet (10') of structure height and if such structure measures less than ten feet (10') but not less than five feet (5') over such floor height intervals, it shall be construed to have an additional floor.
The horizontal area in each floor of a building devoted to off street parking and off street loading facilities and the horizontal area of a cellar floor shall not be included in the "floor area".
FLOOR AREA, FOR DETERMINING OFF STREET PARKING AND OFF STREET LOADING REQUIREMENTS: "Floor area", when prescribed as the basis of measurement for off street parking spaces and off street loading spaces for any use, shall be the sum of the gross horizontal area of the several floors of the building, excluding areas used for accessory off street parking facilities and the horizontal areas of the basement and cellar floors that are devoted exclusively to uses accessory to the operation of the building. All horizontal dimensions shall be taken from the exterior faces of the walls.
FLOOR AREA RATIO: The numerical value obtained by dividing the floor area within a building or buildings on a lot by the area of such lot. The floor area ratio requirement as designated for each district when multiplied by the lot area in square feet shall determine the maximum permissible floor area for the building or buildings on the lot.
FLOOR AREA, USABLE: The words "usable floor area" mean any floor area within outside walls of a residential building exclusive of area in cellars, basements, unfinished attics, garages, open porches, and accessory buildings, but including any area "roughed in" but not completed which is designed and intended for human occupancy.
FREIGHT TERMINAL: A building or area in which freight brought by motor truck or railroad freight cars is assembled or stored for routing in intrastate or interstate shipment by motor trucks or railroad freight cars.
GARAGE, PRIVATE: The words "private garage" mean an accessory building designed and used for the storage of motor vehicles owned and used by the occupants of the building to which it is accessory and in which no occupation or business for profit is carried on. In residence districts, not more than one of the motor vehicles may be a commercial vehicle of not more than two (2) ton capacity.
GARAGE, PUBLIC: The words "public garage" mean a building or portion thereof other than a private or storage garage, designed or used for equipping, servicing, or repairing motor vehicles; hiring, selling, or storing of motor vehicles may be included.
GARAGE, SALE: As regulated in section 3-5-7 of this code.
GARAGE, STORAGE: The words "storage garage" mean a building or portion thereof other than a private or public garage, designed or used exclusively for the storage of motor vehicles, nonmotorized vehicles, boats, and furniture and in which these stored items are not equipped, repaired, hired, or sold, and in which motor fuels and oils are not sold.
GRADE: The elevation of the top of the roadway curb or, if no curb exists, the centerline of the roadway pavement, in either case, measured at a point opposite the centerline of the building wall facing the front lot line, or when there are unusual topographic conditions on the lot, and the building is set back more than twenty five feet (25'), "grade" shall be the average elevation of the finished ground grade elevation at the building walls.
GROUND FLOOR AREA: The lot area covered by a principal building, measured at grade, from the exterior faces of the exterior walls, but excluding open porches, or terraces, garages or carports; except the floor area of a garage may be included in the "ground floor area" when it is a part of the ground floor of a building over one story in height and the floor above the garage is used or intended for use as a part of the principal use.
GUEST, PERMANENT: The words "permanent guest" mean a person who occupies or has the right to occupy a lodging house, rooming house, boarding house, motel, apartment hotel or motel accommodations as his domicile and place of permanent residence.
HOME OCCUPATION: Any occupation or profession for gain or support conducted entirely within the dwelling by a member of the family residing in the dwelling and when such occupation or profession is incidental and secondary to the use of the dwelling for dwelling purposes, and in connection with which:
(A) A sign may be displayed in accordance with title 4, chapter 3, "Signs And Billboards, Awnings And Marquees", of this code, and there is no other display or activity that will indicate from the exterior of the dwelling that it is being utilized in whole or in part for any purpose other than a residential use;
(B) There is only one member of the family residing in the dwelling, plus one additional person, engaged in the pursuit of a home occupation;
(C) Teaching of musical instruments, singing or dancing shall be limited to not more than two (2) pupils at one time, and academic or religious instructions shall be limited to not more than six (6) pupils at one time; and
(D) An accessory building is not used in whole or in part.
HOTEL: An establishment which is open to transient guests, in contradistinction to a lodging house, boarding house, or a rooming house, and is commonly known as a hotel in the city, and which provides customary hotel services such as: maid service, furnishings and laundry of linens, telephone and secretarial or desk service; the use and upkeep of furniture; and bellboy service.
HOTEL, APARTMENT: The words "apartment hotel" mean a hotel in which at least eighty percent (80%) of the hotel accommodations are occupied by permanent guests, securing such accommodations by prearrangement for a continuous period of thirty (30) days or more.
INSTITUTION: A building occupied by a nonprofit corporation wholly for public or semipublic use.
JUNKYARD: An open area of land and any accessory building or structure thereon which are used primarily for buying, selling, exchanging, storing, baling, packing, assembling, or handling waste or scrap materials, including vehicles, machinery, and equipment not in operable condition, or parts thereof, and other metals, paper, rags, rubber tires and bottles.
KENNEL: Any premises or portion thereof on which more than three (3) dogs, cats, or other household domestic animals over four (4) months of age are kept, or on which more than two (2) such animals are maintained, boarded, bred, or cared for, in return for remuneration, or are kept for the purpose of sale.
LAUNDERETTE: A business that provides coin operated, self-service type washing, drying, dry cleaning, and ironing facilities, providing that:
(A) Not more than four (4) persons, including owners, are employed on the premises; and
(B) No pick up or delivery service is maintained.
LOADING SPACE: A space within the principal building or on the same lot, providing for the standing, loading or unloading of trucks and with access to a street or alley.
LODGING HOUSE: A building originally designed for and used as a single- or two-family dwelling, all or a portion of which contains rooms which accommodate persons who are not members of the keeper's family. Lodging, or meals, or both are provided for compensation for three (3) or more but no more than ten (10) persons.
LODGING ROOM: A room or suite of rooms rented as sleeping and living quarters, but without cooking facilities and with or without an individual bathroom. In a suite of rooms, each room which provides sleeping accommodations shall be counted as one "lodging room" for the purpose of this title.
LOT: A single parcel of land which is legally described and recorded as a part of a recorded subdivision plat, and in any case is located within a single block and occupied by or intended for occupancy by, one or more principal buildings for one principal use, together with accessory buildings, structures and uses, yards and other open spaces as required by this title and having its principal frontage on a street. A "lot" is one or two (2) or more lots or parts of lots of record comprising the tract of land which is designated by the owner at the time of application for a building permit as the site to be used, developed or built upon as a unit under single ownership or control. Therefore, a lot may or may not coincide with a "lot of record".
LOT AREA: The area of a horizontal plane bounded by the front, side, and rear lines of a lot.
LOT, CORNER: The words "corner lot" mean a lot located at the intersection of two (2) streets or a lot bounded on two (2) sides by a curving street and any two (2) chords of which form an angle of one hundred twenty degrees (120°) or less measured on the lot side.
LOT, COVERAGE: The words "coverage lot" mean the part or percent of the lot occupied by buildings or structures including accessory buildings or structures.
LOT DEPTH: The horizontal distance between the front lot line and the rear lot line of a lot measured within the lot boundaries.
LOT, INTERIOR: The words "interior lot" mean a lot that is not a corner lot.
LOT LINE, FRONT: The words "front lot line" mean that boundary of a lot which abuts a street line. On a corner lot in a residence district the lot line having the shortest length abutting a street line shall be the front lot line.
LOT LINE, INTERIOR: The words "interior lot line" mean a lot line which does not abut a street.
LOT LINE, REAR: The words "rear lot line" mean that boundary of a lot which is most distant from and is, or is most nearly, parallel to the front lot line and in the case of an irregular, triangular or gore shaped lot, a line ten feet (10') in length within the lot parallel to and at the maximum distance from the front lot line.
LOT LINE, SIDE: The words "side lot line" mean any boundary of a lot which is not a front lot line or a rear lot line.
LOT OF RECORD: A lot which is part of a subdivision, the map of which has been recorded in the office of the county recorder of deeds of Carroll County, Illinois, or a parcel of land, the deed of which was recorded in the office of the recorder of deeds of Carroll County prior to the Savanna zoning ordinance adopted in 1977.
LOT, REVERSED CORNER: The words "reversed corner lot" mean a corner lot, where the side lot line abutting a street is substantially a continuation of the front lot line of the first lot to its rear.
LOT, THROUGH: The words "through lot" mean a lot having a pair of opposite lot lines along the two (2) more or less parallel streets, and which is not a corner lot. Both street lines shall be deemed front lot lines.
LOT WIDTH: The minimum horizontal distance between the side lot lines of a lot measured at the narrowest width within the buildable area.
MANUFACTURING: An establishment, the principal use of which is manufacturing, fabricating, processing, assembling, repairing, storing, cleaning, servicing, or testing of materials, goods, or products.
MARQUEE: A roof like structure of a permanent nature which projects from the wall of a building.
MOBILE HOME: A structure which has or ever had a certificate of title issued by the secretary of state and is designed for permanent habitation and so constructed as to permit its transport on wheels, temporarily or permanently attached to its frame, from the place of its construction to the location, or subsequent locations, at which it is intended to be a permanent habitation and designed to permit the occupancy thereof as a dwelling place for one or more persons. The term "mobile home" shall include a structure that is served by individual utilities and that rests on a permanent foundation with its wheels, tongue, and hitch permanently removed.
MOBILE HOME PARK: A lot developed with facilities for locating three (3) or more "mobile homes"; provided, each mobile home contains a kitchen, flush toilet, and shower or bath, and that such "mobile home park" shall be for use only by nontransient dwellers remaining continuously for more than one month, whether or not a charge is made. It shall not include a sales lot in which motor vehicles or unoccupied trailers are parked for the purpose of inspection or sale.
MOTEL: An establishment consisting of a group of attached or detached lodging rooms with bathrooms, located on a single lot and designed for use primarily by transient automobile tourists. A "motel" furnishes customary hotel services such as maid service and laundering of linen, telephone and secretarial or desk service, and the use and upkeep of furniture. In a "motel" less than fifty percent (50%) of the living and sleeping accommodations are occupied or designed for occupancy by persons other than transient automobile tourists. A "motel" shall not include cooking facilities in any of its lodging rooms.
MOTOR FREIGHT TERMINAL: A building or area in which freight brought by motor truck is assembled or stored for routing in intrastate shipment by motor truck.
NAMEPLATE: A sign indicating the name and address of a building, or the name of an occupant thereof, and the practice of a permitted occupation therein.
NONCONFORMING BUILDING OR STRUCTURE: The words "nonconforming building" or "nonconforming structure" mean any building or structure lawfully established which:
(A) Does not comply with all the regulations of this title or of any amendment hereto governing bulk of the district in which such building or structure is located;
(B) Is designed or intended for a nonconforming use.
NONCONFORMING USE: Any building or structure and the use thereof or the use of land that does not conform with the regulations of this title or any amendments thereto governing use of the district in which it is located, but conformed with all of the codes, ordinances, and other legal requirements applicable at the time such building, or structure was erected, enlarged, or altered, and the use thereof or the use of land was established.
NOXIOUS MATTER OR MATERIAL: The words "noxious matter" or "noxious material" mean a material which is capable of causing injury to living organisms by chemical reaction, or is capable of causing detrimental effects on the physical or economic well being of individuals.
NURSERY, CHILDCARE: The words "childcare nursery" mean an establishment for the part time care of five (5) or more children of preelementary school age in addition to the members of the family residing therein.
NURSING HOME: A home for aged, chronically ill, care of children, infirm, or incurable persons, or a place of rest for those persons suffering bodily disorders, in which three (3) or more persons not members of the family residing on the premises are received, and provided with food, shelter and care, but not including hospitals, clinics, or similar institutions devoted primarily to the diagnosis and treatment of disease or injury, maternity cases, or mental illness.
ODOR: The minimum concentration of odorous matter in the air that can be detected as an odor.
OPEN SALES LOT: Land used or occupied for the purpose of buying, selling, or renting merchandise stored or displayed out of doors prior to sale. Such merchandise includes automobiles, trucks, motor scooters, motorcycles, boats, or similar commodities.
PARKING SPACE: An area, enclosed in a building or unenclosed, reserved for the parking of one motor vehicle with ingress and egress to a street or alley.
PARTICULATE MATTER: Finely divided solid or liquid matter, other than water, which is released into the atmosphere.
PARTY WALL: A common wall which extends from its footing below grade to the underside of the roof and divides buildings.
PLANNED DEVELOPMENT: A parcel or tract of land, initially under single ownership or control, which contains two (2) or more principal buildings and one or more principal use, planned and constructed as a unified development where specific regulations of a given zoning district are modified through the issuance of a special use permit.
PLANNING AND ZONING BOARD: The planning and zoning board of the city of Savanna.
PROCESSING ORGANIZATION OR PROCESSOR: A facility operated by an organization or business that is licensed by the Department of Agriculture to either extract constituent chemicals or compounds to produce cannabis concentrate or incorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis product.
RADIATION HAZARDS: The deleterious and harmful effects of all ionizing radiation, which shall include all radiation capable of producing ions in their passage through matter. Such radiations shall include, but are not limited to, electromagnetic radiations such as X-rays and gamma rays and particulate radiations such as electrons or beta particles, protons, neutrons, and alpha particles.
RAILROAD RIGHT OF WAY: A strip of land with tracks and auxiliary facilities for track operations, but not including freight depots or stations, loading platforms, train sheds, warehouses, car or locomotive shops, or car yards.
RESEARCH LABORATORY: A building or group of buildings in which are located facilities for scientific research, investigation, testing, or experimentation, but not facilities for the manufacture or sale of products, except as incidental to the main purpose of the laboratory.
RESERVOIR STANDING SPACES: Those off street parking spaces allocated for temporary standing of automobiles awaiting entrance to a particular establishment.
ROADWAY: That portion of a street which is used or intended to be used for the travel of motor vehicles.
ROOMING HOUSE: See definition of Lodging House.
SCHOOL, NURSERY: See definition of Nursery, Childcare.
SETBACK: The minimum horizontal distance between a street line and the nearest wall of a building, structure, or operation of a use facing such street line.
SETBACK, ESTABLISHED: The words "established setback" mean when forty percent (40%) or more of the lots fronting on one side of a street within a block are improved, the average of the existing setbacks of such improved lots shall be the "established setback" for determining the depth of required front yards for the lots along such street frontage, as regulated in this comprehensive amendment. However, in no case shall the established setback be greater than the required setback for the district, nor shall the required setback be decreased by more than ten feet (10').
SIGN: A name, identification, description, illustration, display or device which is affixed to, painted or represented upon a building, structure or land and which directs attention to a product, place, activity, person, institution or business. For the purpose of definition, a sign structure may be single face or double face. However, a sign shall not include any display of any court, public, or official notice, nor shall it include the flag, emblem, insignia of a nation, political unit, school, religious or charitable institution, or organization. A sign shall also include a permanent sign located completely within an enclosed building provided such a sign is intended to be viewed primarily from the exterior of the building.
SIGN, ADVERTISING: The words "advertising sign" mean a structure including a billboard on which is portrayed information which directs attention to a business, commodity, service or entertainment not necessarily related to the other uses permitted on the premises upon which the sign structure is located.
SIGN, BUSINESS: The words "business sign" mean a sign which directs attention to a business, commodity, service, or other activity conducted upon the premises upon which such sign is located.
SIGN, GROSS SURFACE AREA OF: The words "gross surface area of sign" mean the entire area within a single continuous perimeter enclosing the extreme limits of the actual surface of a single face sign. It does not include any structural elements lying outside the limits of such sign and not forming an integral part of the display. A double face or V-type sign, erected on a single supporting structure where the interior angle does not exceed one hundred thirty five degrees (135°) shall, for the purpose of computing square foot area, be considered and measured as a single face sign.
SIGN, GROUND: The words "ground sign" mean a sign which is supported by one or more uprights or braces in or upon the ground.
SIGN, PROJECTING: The words "projecting sign" mean a sign which is affixed to any building wall or structure and extends beyond the building wall or parts thereof or structure more than fifteen inches (15").
SIGN, ROOF: The words "roof sign" mean a sign erected, constructed, and maintained above the roof of any building.
SIGN, WALL: The words "wall sign" mean a sign which is affixed to an exterior wall of any building, when such sign shall project not more than fifteen inches (15") from the building wall or parts thereof.
SINGLE OWNERSHIP: That a lot in single ownership is one where the owner does not own adjoining vacant property.
SMOKE: The visible discharge from a chimney, stack, vent, exhaust, or combustion process which is made up of particulate matter.
STORY: That portion of a building, other than a cellar, included between the surface of any floor and the surface of the floor next above it or, if there be no floor above it, then the space between the floor and the ceiling next above it. The floor of a story may have split levels provided that there is not more than a four foot (4') difference in elevation between the different levels of the floor. A basement shall be counted as a story and a mezzanine floor shall be counted as a story when it covers over one-third (1/3) the area of the floor next below it, or if the vertical distance from the floor next below it to the floor next above it is twenty four feet (24') or more.
STORY, HALF: The words "half story" mean a partial story under a gable, hip or gambrel roof, the wall plates of which on at least two (2) opposite exterior walls are not more than three feet (3') above the floor of such story, except that any partial story used for residence purposes, other than for a janitor or caretaker or his family, or by a family occupying the floor immediately below it, shall be deemed a full story.
STREET: Any right of way containing a roadway which affords the primary means of vehicular access to abutting properties. When such right of way is not an existing or dedicated public "street", it shall be not less than forty feet (40') in width, unless herein otherwise regulated. An alley shall not be considered a street.
STREET FRONTAGE: All of the property fronting on one side of a street between two (2) intersecting streets, or in the case of a dead end street, all of the property along one side of the street between an intersecting street and the end of such dead end street.
STREET LINE: The street right of way line abutting a property line of a lot.
STRUCTURE: Anything constructed or erected, the use of which requires more or less permanent location on the ground or attached to something having a permanent location on the ground, including, but without limiting the generality of the foregoing, signs, backstops for tennis courts, and pergolas.
STRUCTURAL ALTERATION: Any change in the supporting members of a building, such as bearing walls, columns, beams or girders, or any substantial change in the roof or in the exterior walls, excepting such repair or replacement as may be required for the safety of the building.
TAVERN: An establishment where liquors are sold to be consumed on the premises but not including restaurants where the principal business is the serving of food.
TOXIC MATTER OR MATERIAL: Those materials which are capable of causing injury to living organisms by chemical means.
TRAILER: Any vehicle or portable structure constructed so as to permit occupancy thereof for lodging or dwelling purposes or for the use as an accessory building or structure in the conduct of a business, trade, or occupation, and which may be used as a conveyance on streets and highways, but by its own or other motive power.
TRANSPORTING ORGANIZATION OR TRANSPORTER: An organization or business that is licensed by the Department of Agriculture to transport cannabis on behalf of a cannabis business establishment or a community college licensed under the Community College Cannabis Vocational Training Pilot Program.
USE: The purpose or activity for which the land, or buildings thereon, is designed, arranged, or intended, or for which it is occupied or maintained, and shall include any manner of performance of such activity with respect to the performance standards of this title.
USE, ACCESSORY: Any "accessory use" is one which is incidental to the dominant use of the premises.
USE, CONDITIONAL: The words "conditional use" mean a use that has unique characteristics and is deemed desirable or necessary in a district or districts for public convenience and welfare, but due to its unique characteristics its location and development in a district are conditioned upon conformance with special standards herein set forth for each conditional use. The issuance of a permit and zoning certificate for a conditional use is predicated on the approval in each case by the city council after receiving the recommendation from the planning and zoning board.
USE, LAWFUL: The words "lawful use" mean the use of any building, structure, or land that conforms with all of the regulations of this title or any amendment hereto and which conforms with all of the codes, ordinances, and other legal requirements, as existing at the time of the enactment of this title or any amendment thereto, for the structure or land that is being examined.
USE, NONCONFORMING: See definition of Nonconforming Use.
USE, PERMITTED: The words "permitted use" mean any use which may be lawfully established in a particular district or districts, provided it conforms with all requirements, regulations, and performances, if any, of such district.
USE, PRINCIPAL: The words "principal use" mean the dominant use of land or buildings as distinguished from a subordinate or accessory use.
VEHICLE, MOTOR: The words "motor vehicle" mean any passenger vehicle, truck, truck trailer, trailer, or semitrailer propelled or drawn by mechanical power.
VENDING MACHINE: A machine for dispensing merchandise or services designed to be operated by the customer.
VIBRATION: The periodic displacement, measured in inches, of earth at designated frequency, cycles per second.
YARD: An open area, on a lot which is unobstructed from its lowest level to the sky, except as otherwise provided in this title.
YARD, CORNER SIDE: The words "corner side yard" mean a side yard which adjoins a street line.
YARD, FRONT: The words "front yard" mean a yard which is bounded by the side lot lines, front lot line, and the front yard line.
YARD, INTERIOR SIDE: The words "interior side yard" mean a side yard which adjoins another lot or alley separating such side yard from another lot.
YARD LINE: A line in a lot that is parallel to the lot line along which the applicable yard extends and which is not nearer to such lot line at any point than the required depth or width of the applicable yard. A building, structure or other obstruction shall not encroach into the area between the "yard line" and such adjacent lot line, except for such permitted obstruction in yards as are set forth in this title.
YARD, REAR: The words "rear yard" mean a yard which is bounded by side lot lines, and the rear yard line.
YARD, SIDE: The words "side yard" mean a yard which is bounded by the rear yard line, front yard line, side yard line and side lot line.
ZONING DISTRICTS: The districts into which the city of Savanna has been divided for zoning regulations and requirements as set forth on the zoning district map. (1977 Code; amd.
