9-3-40: BICYCLE PATHS:
   (A)   General Prohibitions: No person shall ride any bicycle or use a bike path without complying with the terms of this section.
      1.   All persons using the bike path shall stay to the right except when passing and proceed in single file when approaching others using the trail.
      2.   All persons using the bike path shall signal clearly or give a clear warning before passing.
      3.   All persons using the bike path shall keep pets on a short leash and clean up after their pet.
      4.   Alcoholic beverages and illegal drugs are not permitted on the trail.
      5.   Firearms, fireworks and fires are not permitted on the trail.
      6.   All trail users should use a light and reflectors after dusk and before dawn.
      7.   All trail users should move off the trail when stopped to allow others to pass.
      8.   All trail users should yield to other users when entering and crossing the trail.
   (B)   Due Care For Safety:
      1.   All operation of bicycles on bike paths shall be consistent with the rules of the road established for bicycles and otherwise consistent with this chapter.
      2.   No person shall ride a bicycle in a reckless manner on a bike path.
      3.   No person shall ride a bicycle without exercising due care for the safety of other persons and property.
   (C)   Prohibited Uses On Bicycle Paths:
      1.   Prohibition Of Operation Of Motor Driven Vehicles On Bike Paths: It shall be unlawful for any person to operate or ride a motor driven vehicle including snowmobiles, motorcycles, motor scooters, all-terrain vehicles, golf carts or any other motor driven vehicles on bike paths.
      2.   Exceptions: Said prohibition on motor driven vehicles shall not apply to:
         (a)   Official municipal maintenance, tour and emergency vehicles;
         (b)   Persons with a bona fide disability operating a motorized wheelchair or similar device.
   (D)   Penalties: Any person convicted of violation of this section shall be punished by a fine of not less than twenty five dollars ($25.00) and no more than five hundred dollars ($500.00). (Ord. 1744, 9-23-2003)
