7-5-9: PENALTIES:
   (A)   Any person found to be violating any provision of this chapter, except section 7-5-6, shall be served by the city with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations . or take the necessary corrective actions to abate a violation. Due to the potential life and safety issues that can result from a failure to comply with this chapter, or to take the necessary corrective actions to abate the violation, non-compliance may result in the water service being shut-off to the property in violation. If the property does not have water service, the City may terminate the sewer service to the City sewer main. The cost of all work associated with this action will be charged to the property owner, as well as the cost to reinstate the sewer service lateral. Failure to pay any and all cost may result in a lien being placed against the property in question.
   (B)   Any person who shall continue any violation beyond the time limit provided for in subsection (A) of this section, shall be guilty of a misdemeanor, and on conviction thereof shall be fined in the amount not exceeding five hundred dollars ($500.00) for each violation. Each day in which any such violation shall continue shall be deemed a separate offense.
   (C)   Any person violating any of the provisions of this chapter shall become liable to the city for any expense, loss or damage occasioned by the city by reason of such violation. (1977 Code; amd. Ord. 1248, 11-23-1982; Ord. 2283, 12-8-2020)
