7-3-4: CURBSIDE RECYCLING SERVICE:
   (A)   Recyclable materials shall be collected on an alternating weekly basis. Contractor will collect properly prepared materials as spelled out in exhibit B of the garbage and recycling collection and disposal contract. Collection will occur throughout the city on Monday. The collection of recyclable materials will occur at all residential dwelling units. The contractor may offer recycling to multi-family dwellings of five (5) or more units at its own discretion. Contractor may establish reasonable rules for placement and collection of recyclable materials and agrees to provide to the city and each dwelling unit a written copy of all such rules.
   (B)   Recyclable materials may be deemed by contractor to be unacceptable for collection. However, contractor is required to give written notice on forms provided by contractor, informing the occupants of the residential dwelling unit that recyclable materials are in an unacceptable condition for collection. The notice shall also give instruction for proper and improper preparation of recyclable materials. On the first occurrence, improperly prepared recyclable materials shall be picked up by contractor. Subsequent instances of unacceptable recyclable materials may be rejected.
   (C)   Contractor shall only pick up and dispose of recyclable materials in approved recyclable containers. All residential customers entitled to collection under this agreement shall be provided with a new eighteen (18) gallon recycling bin by the contractor. These containers shall remain the property of the contractor. The city shall provide recycling bins to new residents and residents of territories annexed to the city. Residents may purchase additional recycling containers from the city. In addition, each such customer shall receive from contractor a written statement explaining the recycling program including the material that will be accepted for recycling and the manner in which recycling materials must be made available for pick up by contractor.
   (D)   The city agrees that the city will provide replacement recycling containers for a fee when notified by a resident or contractor that a recycling container is damaged or missing. If contractor is at fault, contractor must notify the city promptly and the city will replace the container seeking reimbursement from contractor for the replacement container. If the resident is at fault (i.e., a lost container, damaged container), a replacement container will be provided by the city and the resident will be required to pay the city for the replacement container. If the container is stolen, the resident must report the theft to the city police department. Upon verification of theft, the city will secure a replacement container only for the resident at the city's expense. Residents moving into a new home within the city or residents of a territory newly annexed to the city will contact the city for a recycling container. Residents moving into a home previously owned will be given the bin assigned to the existing resident as the bin will be registered to the home's street address. (Ord. 2053, 7-23-2013)
