5-2-7: NOTICE OF VIOLATION:
All buildings, structures, businesses or premises constructed, built, located or maintained in violation of any of the provisions of this chapter shall be held to be and are hereby declared to be nuisances and shall be abated as such as provided by ordinances pertaining to nuisances in general, in addition to any other penalty herein provided for. Provided, however, that before any prosecution shall be instituted hereunder, the fire chief or any policeman, in all cases where circumstances will permit, shall give a five (5) day written notice to the owner of the premises involved or other person in charge of same demanding that the nuisance complained of be abated within that time. In all cases of urgent necessity where delay may endanger life or property, the fire chief or any policeman may, by himself or with the help or aid of others, enter upon the premises in question and abate the nuisance summarily in the interest of the public welfare.
