5-2-4: JUNKYARDS:
   (A)   It shall not be lawful for any person to establish or locate any junkyard or similar place within the fire limits of the city or to locate or establish any junk store therein; neither shall it be lawful for any junkyard or junk store to be located within three hundred feet (300') of any church, public or private school, hospital, theater or other place designed for public assemblages; nor within any block or other section encompassed by streets or public roads, without the written consent of a majority of the owners of all real estate therein, used either for residence or retail business purposes, or both; nor within three hundred feet (300') of any such property fronting on any street or public road in any other part of the property or both sides thereof; provided that, before any junkyard or junk store shall be located as to front on any street or public road adjacent to any block or other section where permission as aforesaid is required, the written consent of a majority of the same class of real estate owners on the opposite side of the street or public road shall also be obtained.
   (B)   The written consent herein required shall be filed with the city clerk, whose duty it shall be to present the same to the city council at the next regular meeting thereafter, to the end that such consent may be spread at large upon the records of such meeting and be made a matter of permanent record. The regulations herein contained in regard to junkyards and junk stores, including that of location, shall apply to all such enterprises, whether retail or wholesale, and to all such businesses as may now be located in any place within the city contrary to the provisions of this chapter, to remove the same so as to conform to the requirements thereof.
