§ 16.85.180 REQUIRED FINDINGS - RESIDENTIAL CONDOMINIUM CONVERSIONS.
   In approving a conditional use permit for a residential condominium conversion project, the Planning Commission or City Council must find that the proposed residential condominium conversion project would not adversely affect the supply and availability of rental housing in the city or within a specified area in the city and make the following findings:
   (A)   All provisions of this title and the Subdivision Map Act are met, including all notices required pursuant to Cal. Gov't Code § 66427.1;
   (B)   The proposed conversion is consistent with the General Plan;
   (C)   The proposed conversion will conform to this Development Code, in effect at the time of tentative map approval, except as otherwise provided in this chapter;
   (D)   The overall design and physical conditions of the condominium conversion achieves a high degree of appearance, quality and safety; and
   (E)   The current vacancy rate for rental units within the city is not less than 2.45% except as otherwise provided in the chapter.
