(A) The county’s Board of Health shall consist of seven members residing in the county, including: a member of the County Board of Commissioners and six other members, appointed by the county’s Board of Commissioners with advice and consent of the Health Officer pursuant to UCA § 26A-1-109.
(B) Board members shall be nonpartisan and include geographical representation from both the incorporated and unincorporated areas of the county. Members should have knowledge or an interest in public health and environmental matters.
(C) Any potential conflict of interest of any member shall be disclosed in accordance with applicable statutes and countywide policies and procedures.
(D) The Board shall adopt bylaws governing the election of officers, committees, task forces and other advisory bodies to the Board. The Board members’ terms of service shall be governed by state law.
(E) A majority of the members may not:
(1) Be primarily engaged in providing health care to individuals or in the administration of facilities or institutions in which health care is provided;
(2) Hold a fiduciary position or have a fiduciary interest in any entity involved in the provision of health care;
(3) Receive either directly or through a spouse more than one-tenth of the member’s gross income from any entity or activity relating to health care; or
(4) Be members of one type of business or profession.
