§ 130.001 NIGHT HUNTING.
   No person shall do night hunting during the period of one-half hour after sundown and one-half hour prior to sun-up of any calender day, except as hereinafter provided.
   (A)   A land owner or any person to whom he or she has given written consent may do night hunting on his or her privately-owned land any night without having to obtain a night hunting permit from the Sheriff.
   (B)   No night hunting shall be done on private property on which a “Private Property” sign is posted on each road entering into such private property; except, the owner of such property or any person to whom he or she has given written consent may do night hunting on said premises.
   (C)   A person may do night hunting during periods of June 1 to March 1 upon obtaining from the Sheriff an annual night hunting permit, without fee.
   (D)   No night hunting shall be done by a person under 18 years of age unless accompanied by a person 18 years of age or more and each of such individuals shall have first obtained a night hunting permit from the Sheriff.
   (E)   Any firearm used in night hunting must use center-fire cartridges and have an attached telescopic sight of at least four power and the person hunting must have a spotlight of at least 50 candlepower.
