4-2-1: DEFINITIONS:
As used in this chapter, the following words shall have the following meanings:
ALTERNATIVE NICOTINE PRODUCT: A product or device not consisting of or containing tobacco that provides for the ingestion into the body of nicotine, whether by chewing, smoking, absorbing, dissolving, inhaling, snorting, or sniffing, or by any other means. "Alternative nicotine product" excludes cigarettes, "smokeless tobacco", or other "tobacco products" as these terms are defined in this section and any product approved by the United States food and drug administration as a nontobacco product for sale as a tobacco cessation product, as a tobacco dependence product, or for other medical purposes, and is being marketed and sold solely for that approved purpose.
SMOKE: To light, emit, or exhale the smoke of a pipe, cigar, cigarette, or any other tobacco product.
SMOKELESS TOBACCO: Any tobacco product that is suitable for dipping or chewing.
TOBACCO PRODUCT: Any cigar, cigarette, smokeless tobacco, or tobacco in any of its forms.
VILLAGE HALL OR BUILDING: Any structure built for the support, shelter or enclosure of persons, animals, chattels or property of any kind in which is permanently affixed to the ground and which is owned by the village of San Jose. (Ord. 344, 12-15-1997, eff. 12-15-1997; amd. 2016 Code)
