§ 150.164 EXCEPTIONS.
   (A)   The owner of any property on which a solar energy collector will be constructed or installed may apply to the Community Development Director for a modification of, or exception from, any of the requirements of this subchapter in accordance with §§ 153.440 through 153.447. The Community Development Director may approve a modification or exception if it finds that:
      (1)   The application of the requirement would create an undue hardship for the property owner because of the size, shape, or location of the property or any structure thereon; and
      (2)   The modification or exception will not be detrimental to the public health, safety, or welfare or to surrounding property values.
   (B)   In approving a modification or exception, the Community Development Director may impose reasonable conditions, including, but not limited to, a requirement that amenities be provided to compensate for the modification or exception concerning any of the requirements of this subchapter.
