   935.15 STOP WORK ORDERS.
   (a)   The Director of Engineering Services, or authorized representative, may, without prior notice, suspend all work as described in the permit when such suspension is necessary to stop an actual or threatened discharge which presents or may present imminent and substantial danger to the environment, or to the health or welfare of persons, or to the MS4 or Waters of the State. If the violator fails to comply with a stop work order, the Director of Engineering Services may take such steps as deemed necessary to stop or prevent the discharge.
   (b)   Stop work orders may be issued by the Director of Engineering Services, or authorized representative, verbally with written notification to follow.

   935.16 INJUNCTIVE RELIEF.
   It shall be unlawful for any person to violate any provision or fail to comply with any of the requirements of this Chapter pursuant to Ohio R.C. 3709.211. If a person has violated or continues to violate the provisions of this Chapter, the Community may petition for a preliminary or permanent injunction restraining the person from activities which would create further violations or compelling the person to perform abatement or remediation of the violation.

   935.17 VIOLATIONS DEEMED A PUBLIC NUISANCE.
   In addition to the enforcement processes and penalties provided, any condition caused or permitted to exist in violation of any of the provisions of this Chapter is a threat to public health, safety, and welfare, and is declared and deemed a public nuisance pursuant to Section 521.10 of this Code of Ordinances.    935.18 APPEAL.
   Any person aggrieved by any order, requirement, determination, or any other action or inaction by the City of Sandusky in relation to this Chapter may appeal to the court of common pleas. Such an appeal shall be made in conformity with applicable state law. Written notice of appeal shall be served on the City of Sandusky.

   935.99 PENALTY.
   (a)   Any person, firm, entity or corporation (including, but not limited to, the owner of the property, the owner's agents and assigns, occupant, property manager, and any contractor or subcontractor) who violates or fails to comply with any provision of this Chapter is guilty of a misdemeanor of the third degree for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
   (b)   The remedies listed in this chapter are not exclusive of any other remedies available under any applicable Federal, State or local law and it is within the discretion of the City Engineer to seek cumulative remedies.
   (c)   The imposition of any other penalties provided herein shall not preclude the City of Sandusky from instituting an appropriate action or proceeding in a Court of proper jurisdiction to prevent an unlawful development, or to restrain, correct, or abate a violation, or to require compliance with the provisions of this Chapter or other applicable laws, ordinances, rules, or regulations, or the orders of the City of Sandusky.
