(a) Any person, firm or corporation desiring to conduct, carry on or engage in the business of sewer tapping or sewer building or to excavate for, or tap, or construct any sewer, gas main, water or other underground utility in any public grounds in the City shall give to the City a surety bond, and provide public liability insurance as provided for and in accordance with the provisions of Section 1317.09, which bond and evidence of public liability insurance shall be approved as to form by the Law Director and placed on file in the City Manager’s office.
(b) The contractor shall save, indemnify and keep harmless the City against any and all liabilities, judgment, damages, costs and expenses which may in any case accrue against this City in consequence of the contractor’s work.
(c) Regulations and Specifications. The City Engineer is authorized and directed to adopt and enforce specifications and regulations governing work done under this chapter, for the purpose of providing control of the installation and use of house sewers and other private sewers and of all other work done wherein the interests and safety of the public may be affected.
(d) Removal of Defective Work. Should any work done by any person, firm or corporation under the provisions of this chapter be found to be defective at any time during the guarantee period, the work shall be remedied or removed and replaced by the person, firm or corporation. Upon failure by the person, firm or corporation to comply forthwith with any order of the City Manager made under the provisions of this section, the City may, at the expense of the person, firm or corporation or their bondsmen cause the defective work to be remedied or removed and replaced.
(e) Emergency Repairs. Nothing in this chapter shall be construed as prohibiting any person, firm or corporation licensed to conduct, carry on and engage in the business of excavating or sewer tapping and sewer building from making emergency repairs on public or private utility installations or structures in any public street, alley, road or public grounds, in the City when the emergency repairs are necessary to safeguard life, health and property.
(f) Registration Fee. Excavators, sewer tappers and sewer builders shall pay for the current calendar year an annual registration fee of twenty-five dollars ($25.00).
