955.01 DEFINITIONS.
   For the purposes of this chapter, the words and phrases set forth hereinbelow shall have and be afforded the meaning and definition ascribed to each of the same respectively.
(1)   "Bulky waste items" means major household appliances, including, but not by way of limitation, refrigerators, washers, dryers, hot water tanks, cooking stoves, dishwashers, and televisions; furniture, trees and limbs of trees, stumps, brush, and logs; and construction and demolition waste and debris as well as other items which may be determined by the City Manager from time to time as being bulky waste items.
(2)   "City Manager" means the City Manager, or other Chief Executive Officer of the City of Sandusky, Ohio, or the representative duly authorized by said individual to act in behalf thereof.
(3)   "Commercial establishments" means business establishments engaged in the purchase and sale, and/or barter of commodities including, but not by way of limitation stores, markets, and restaurants and other establishments maintained for the provision of food and beverages for human consumption, hotels, motels, automotive service stations, and all such similar establishments.
(4)   "Commercial hauler" means any person who is engaged on a full-time or part-time basis, permanently or temporarily, in the process and activity of collecting, conveying and/or disposing of solid waste, garbage, refuse, compostable material, bulky waste items, recyclable materials or recyclables, and/or other discarded material which have been accumulated within the City of Sandusky, Ohio, in connection with a residential, but not an industrial or commercial use other than that actually produced by said person or in direct connection to a premises of which said person is the owner or an occupant. Further, "commercial hauler" does not include any person who is engaged solely in the provision, maintenance, collection, and removal of dumpsters and/or roll-off containers which are utilized solely for the collection, storage, conveyance, and removal of construction and/or demolition debris, scrap metal, stone, and dirt generated or created, and collected at the site or location of said dumpster or container.
(5)   "Compostable material" means trees, limbs of trees, logs, leaves, branches, clippings, grass, vegetation, and any other material which is subject to processing as part of a composting process for the purpose of recycling the same.
(6)   “Composting process" means the procedure and activity of processing compostable materials so as to reduce the volume thereof, and/or modify the nature, content, makeup, and composition thereof so as to render said material practically usable or reusable for recycling purposes.
(7)   "Curb" means the boulevard, tree lawn or devil strip, or any other area of a property between a public street or alley and the front or facing of any building or structure which occupies the property, but excluding any public street, alley, sidewalk, or walkway, and any driveway.
(8)   "Curbside collection" means the process or activity of placing properly packaged or contained garbage, solid waste, refuse, compostable material, other discarded material, and/or recyclables, for the purpose of the collection and conveyance thereof by commercial haulers, upon a curb.
(9)   "Collection," "commercial collection," or "commercial collection activities" means the process or activity effected and/or undertaken by commercial haulers of collecting and/or conveying garbage, solid waste, bulky waste items, refuse, compostable material, other discardable material, and/or recyclables other than that actually produced by said person or in direct connection to the premises of which said person is the owner or an occupant, in compliance with and pursuant to this chapter.
(10)   "Curbside collection map" means a map depicting and illustrating the five (5) curbside collection zones within the City of Sandusky, Ohio, within each of which the properly packaged or contained garbage, solid waste, refuse, compostable material, bulky waste items, and/or other discarded material, and/or recyclables may be collected and conveyed by commercial haulers on one (1) designated day of each week in compliance with, and pursuant to the terms and provisions of this chapter.
(11)   “Curbside collection zones" means the five (5) geographic areas within the City of Sandusky, Ohio, as depicted and illustrated by the collection map, within which collection shall be permitted by licensed commercial haulers on one weekday each week in compliance with and pursuant to this chapter.
(12)   "Disposal unit" means any incinerator that will effectively reduce all nonmetallic and similar noncombustible materials to an ash that is inert from the standpoint of the intent of this chapter as well as any comminutor or garbage grinder that is attached to the sanitary disposal system in any structure, providing that said apparatus conforms to the regulations contained within the Sewer Ordinances of the City.
(13)   "Garbage" means all putrescible wastes except wastes of the human body, other water carried wastes and infectious wastes as-defined in Section 3734.01(R) of the Ohio Revised Code or any subsequent amendment thereof or modification thereto, including, but not by way of limitation, all vegetable and animal wastes resulting from the handling, preparation, and cooking of foods, and any unwashed containers that previously contained food or liquid prepared or proposed for human or animal consumption.
(14)   "Ground" means the earth, as well as the surface of a driveway, a sidewalk, a floor, or any other surface on, in or about real property on or in which garbage or other refuse may be placed, deposited, kept, accumulated, and/or stored.
(15)   "Health Commissioner" means the individual appointed by the Board of Health of jurisdiction within the City of Sandusky, Ohio, to serve, either permanently or temporarily, as the Executive Officer of said Board, or the representative duly authorized by said Executive Officer to act in behalf thereof.
(16)   "Refuse" or "other refuse" means ashes, crockery, bottles, tin cans, paper and other wood pulp products, boxes, rags, old or discarded clothing, bedding, mattresses and upholstered furniture, and all other similar nonputrescible wastes and discarded materials not otherwise defined herein.
(17)   "Person" means the state of Ohio or any political subdivision, agency, office or enterprise thereof, any corporation, public or private, and any individual, partnership or other entity.
(18)   "Premises" means any land building or structure on or in which solid waste may be placed, deposited, kept, accumulated, and/or stored.
(19)   "Ratguard" means a smooth metallic device that will effectively prevent rodents from climbing to places where foodstuffs may be legally placed, deposited, kept, and/or stored out of doors, including, but not by way of limitation, feeding stations for wild birds.
(20)   "Ratproof" or "ratproofing" means as applied to buildings, any stipulation related to the prevention of the presence or infestation of rodents which is presently contained within the Building Codes of the City of Sandusky, Ohio, or which may be added thereto hereafter.
(21)   "Recyclable materials or recyclables" means cardboard, corrugated paper, container glass, plastics, and aluminum and bi-metal beverage cans, and newsprint.
(23)   "Recycling" or "recycling services" means the process of collecting, sorting cleansing, treating, and/or reconstituting waste, garbage, refuse or other discarded material for the purpose of recovering, using or reusing the same.
(24)   "Recycling program" or "recycling services" means an ongoing process or procedure which provides for, permits, facilitates, and allows the collection, conveyance and disposition of recyclable materials or recyclables produced, generated and/or accumulated within the City of Sandusky, Ohio, for the purpose of recycling the same.
(25)   "Residence" means any enclosure, other than those kept, maintained, or operated solely as commercial or industrial establishments, used as a human domicile, including, but not by way of limitation, multiple and single-family dwellings, mobile homes and house trailers, living quarters within and/or attached to boathouse structures or boatports, camps, and any other structure within which humans may sleep, or prepare or consume food.
(26)   "Rodent" means any mouse, rat, or other animal that falls within that biological category excluding certain such animals which are kept as furbearers, or pets, or for clinical or research purposes, providing they are kept or confined in a manner satisfactory to the Health Commissioner.
(27)   "Solid waste" means such unwanted residual solid or semisolid material as results from industrial, commercial, agricultural, and community operations, excluding earth or material from construction, mining, or demolition operations, or other waste materials of a type that would normally be included in demolition debris, nontoxic fly ash, spent nontoxic foundry sand, and slag and other substances that are not harmful or inimical to public health, and including, but not by way of limitation, garbage, tires, combustible and noncombustible material, street dirt, and debris, and excluding any material that is an infectious waste or a hazardous waste. To the extent that the same is appropriate and reasonably consistent with the terms and provisions of this chapter "solid waste", "garbage", "refuse", and "compostable materials" shall be interchangeable, and shall have and be afforded the same meaning hereunder.
(28)   "Licensed commercial hauler" means any person engaged in commercial hauling activities within the City of Sandusky, Ohio, who has secured a license permitting him to afford said services or to engage in said activity in compliance with this chapter, and which license is current and in effect.
