933.23 POWERS AND AUTHORITY OF INSPECTION.
   (a)   The Utilities Director as director of the POTW shall apply the terms and conditions of this chapter to all industrial users whose discharges are introduced into the City's POTW.
   The Engineer, Utilities Director and/or other duly authorized employees of the City bearing proper credentials and identification shall be permitted to enter all properties at all reasonable times for the purpose of inspection, observation, measurement, sampling and testing pertinent to discharge to the community system in accordance with the provisions of this chapter. The City shall have the right to set up on the property such devices as are necessary to conduct sampling, inspection, compliance monitoring and/or metering operations. If entry to any property in the City is refused by the occupant thereof, the Engineer, Utilities Director or duly authorized employee shall request the City Law Director to apply to a court of competent jurisdiction for a warrant authorizing entry.
   (b)   The Engineer, Utilities Director and/or other duly authorized employees are empowered to obtain information which has a direct bearing on the kind and source of discharge to the wastewater collection system. If such information is considered confidential by the industry involved, because the revelation thereof to the public might result in an advantage to competitors, it shall be marked "confidential" and shall be kept in a separate file and not available to the public except as specifically provided herein. Confidential information shall not be disclosed by the Engineer, Utilities Director and/or other duly authorized employees to the public or to any other persons except to employees and officials to the extent necessary for the administration and enforcement of this chapter. If a request is received to disclose confidential information, it shall only be released in compliance with applicable State and federal laws pertaining to trade secrets in force at the time the request is made.
   Notwithstanding the above, information and data submitted to the City with respect to the nature and frequency of discharge at the point of discharge shall be available to the public or other governmental agency without restrictions upon receipt by the City of a proper request.
   (c)   The Engineer, Utilities Director and/or other duly authorized employees of the City bearing proper credentials and identification shall be permitted to enter all private properties through which the City holds a duly negotiated easement for the purposes of, but not limited to, inspection, observation, measurement, sampling, repair and maintenance of any portion of the wastewater facilities lying within such easement. All entries and subsequent work, if any, on such easement, shall be done in full accordance with the terms of the duly negotiated easement pertaining to the private property involved.
