705.07 ARCADE OPERATING REQUIREMENTS.
   No license to operate an arcade shall be issued unless the following provisions are complied with by the operator of the arcade:
(a)    No arcade shall be open for business except between the hours of 3:00 p.m. to 10:00 p.m. Monday through Friday, and between the hours of 10:00 a.m. to 10:00 p.m. on Saturdays, and between the hours of 12:00 noon to 10:00 p.m. on Sundays;
(b)    There shall be at least one supervisory employee twenty-one years old or older in attendance during operating hours;
(c)    It is the responsibility of the owner to ensure that the litter originating from the arcade is cleaned up from the subject property, as well as from the surrounding properties;
(d)    Each arcade shall provide a minimum of one toilet and lavatory facilities accessible to customers and employees;
(e)    Bicycle racks shall be provided on the same premises of any game arcade and shall provide a total of at least one bicycle stall for each game located within the arcade. Bicycle racks shall not be located in any required landscaped areas, entrances, exists, walkways to buildings, driveways, within any legally required parking space, public way or in any such a fashion as to obstruct any entrance or exit to any premises;
(f)    An arcade shall not be located within 500 feet of a school or church;
(g)    Game machines shall be located no closer than twelve inches from any common wall assembly separating the arcade from any adjacent building or portion of a building. Where machines are located along one side of an aisle such aisle shall be a minimum of sixty-six inches in width and shall be unobstructed. When machines are located on both sides of any aisle, the aisle shall be not less than ninety inches in width and shall be unobstructed. The maximum number of machines in any arcade shall not exceed one machine for every forty square feet of gross floor allotted to the arcade operation;
(h)    No licensee shall permit any indecent, immoral or profane language, or indecent, immoral or disorderly conduct upon the premises;
(i)    No licensee shall permit the premises to become a gathering place for disorderly persons of any type;
(j)    No licensee shall permit gambling in any form or the possession or use of gambling paraphernalia upon the premises;
(k)    No licensee shall permit the offering of any prize, award, merchandise, gift or anything of value to any person in connection with the use of any amusement device;
(l)    No licensee shall permit intoxication or the possession or use of alcoholic beverages upon the premises;
(m)    No licensee shall permit the possession or use of any unlawful drug, narcotic or controlled substance, including marijuana, or of any drug paraphernalia upon the premises; and
(n)    Each licensee shall, at all times, open each and every portion of the premises for inspection by the Police Department and other City departments for the purpose of enforcing any provisions of this chapter. (Ord. 86-032. Passed 4-21-86.)
