§ 159.31 PERMITS; INFORMATION REQUIRED.
   (A)   (1)   It is unlawful for any person to erect, construct or place or re-erect, replace or repair any tower without first making application to the Building Official and securing a permit.
      (2)   The applicant must provide at the time of application sufficient information, including a site plan, to indicate that the construction, installation and maintenance of the antenna and tower will not create a safety hazard or damage to the property of other persons.
      (3)   The applicant must pay the fee prescribed in § 36.02 of this code of ordinances. An additional fee must be paid for the review of any plans or other submissions by an engineer selected by the city.

   (B)   In addition to the information required elsewhere in this chapter, applications for towers shall include the following supplemental information.
      (1)   A report from a qualified and licensed professional engineer that describes the tower height and design, including a cross-section, and elevation. The report must include written evidence that the proposed structure meets the structural requirements of this code and the Building Code;
      (2)   Documentation of steps the applicant will take to avoid interference with established public safety telecommunications. A preliminary or certified written statement from an engineer that the construction and placement or the reception and transmission functions of the antenna and tower will not interfere with public safety communications and the usual and customary transmission or reception of radio, television or other communications service enjoyed by adjacent properties;
      (3)   Information describing the tower’s capacity including the number and type of antennas that it can accommodate;
      (4)   Certification that the proposed tower complies with regulations administered by the Federal Aviation Administration;
      (5)   A report from a qualified and licensed professional engineer, which demonstrates the tower’s compliance with the aforementioned structural and electrical standards;
      (6)   Written documentation that the applicant has made diligent but unsuccessful efforts for permission to install or co-locate the applicant’s telecommunications facilities on towers or antenna support systems located within one mile of the proposed tower site, or written, technical evidence from an engineer certifying that the proposed tower or antenna cannot be installed or co-located on another person’s tower or antenna support system located within a one mile radius of the proposed tower site and must be located at the proposed site in order to meet the coverage requirements of the applicant’s wireless telecommunications system;
      (7)   A copy of the tower’s lease or written agreement; and
      (8)   Site plan showing surrounding land parcels and uses within setback requirements and other such information, including landscaping, as required in this chapter. Plans must be submitted in electronic form for city. use in making presentations and providing information to commissions, the public and the City Council.
