In addition to the requirements of § 159.16(D) of this chapter, new or modified towers and antennas must meet the following design requirements.
(A) Towers and antennas must be designed in accordance with applicable laws and regulations such as the regulations of the Federal Aviation Administration.
(B) Towers must be of a monopole design unless the party proposing construction of the tower demonstrates that an alternative design is necessary to meet engineering requirements.
(C) Tower locations must be maintained in a safe and reasonable condition in order to prevent accidents. Tower locations must be adequately fenced in order to deter trespass by children or other persons.
