§ 154.009 NEW BUILDINGS.
   (A)   General rule. A high-density residential, commercial and industrial building constructed, whether with or without a garage, must conform to and comply with the provisions of this subchapter. All residential property that abuts a street lined with concrete curb and sidewalk is also included in this rule.
   (B)   Requirements. All such buildings must provide an impervious surface driveway from the curb line to the property line of the lot upon which the building is to be placed. Concrete must be air- entraining portland cement concrete. The concrete driveway must rise at the rate of one-fourth inch per foot from the top of the curb line to the property line of the lot. The driveway may not be less than 12 feet in width and be not less than three inches thick.
   (C)   Escrow required.
      (1)   A cash escrow must be deposited with the city to guarantee the construction of the concrete driveway. A certificate of occupancy may not be issued for any building until all of the requirements of the Building Code, zoning or other ordinances of the city have been complied with, including the construction of the concrete driveway as prescribed above; except that, after October 15 of each calendar year a certificate of occupancy may be issued stipulating the driveway is to be constructed prior to July 1 of the following year.
      (2)   In the event that the driveway is not constructed by July 1 of the following year, then the permittee will be considered in default, and if the permittee is in default, the escrow will be forfeited and the city, its employees or its authorized agent must enter upon the lot and complete the concrete driveways as prescribed in this subchapter.
