§ 152.01 INTERNATIONAL PROPERTY MAINTENANCE CODE ADOPTED.
   (A)   The International Property Maintenance Code (“IPMC”), published by the International Code Council, Inc., is adopted by reference, subject to the changes set forth in subdivision 2, below.
   (B)   For the purposes of this chapter, the IPMC is amended as follows:
Section 101.1. Insert the name “City of Sandstone.”
Section 102.3. In the first sentence, delete the terms: “International Building Code, International Energy Conservation Code, International Fire Code, International Fuel Gas Code, International Mechanical Code, International Residential Code, International Plumbing Code, and NFPA 70 and replace with “Minnesota State Building Code, as defined in Minnesota Rule Part 1300.0020.” And, in the second sentence, delete the term “International Zoning Code and insert “Sandstone City Code.”
Section 102.7. Revise the paragraph as follows: “The codes and standards referred in this code shall be those that are listed in the Minnesota State Building Code and considered part of the requirements of this code to the prescribed extent of each such reference. Where differences occur between provisions of this code and the Minnesota State Building Code, the Minnesota State Building Code shall apply.”
Section 103. Delete sections 103.1, 103.2, 103.3, and 103.5 in their entirety.
Section 107. Delete in its entirety.
Section 108.3. Delete the references to “Section 107.3 and “Section 107.2" and insert “Chapter 152 of the Sandstone City Code.”
Section 109. Delete in its entirety.
Section 110.1. In the first sentence delete the term “shall” and replace with the term “may.”
Section 110.2. Delete the term “Section 107 and insert the term “Chapter 152 of the Sandstone City Code.”
Section 112.4. Delete the phrase “liable to a fine of not less than [AMOUNT] dollars or more than [AMOUNT] dollars” and insert the phrase “guilty of a misdemeanor.”
Section 201.3. Delete the terms “International Building Code, International Existing Building Code, International Fire Code, International Fuel Gas Code, International Mechanical Code, International Plumbing Code, International Residential Code, International Zoning Code or NFPA 70 and insert “Minnesota State Building Code, as defined in Minnesota Rule 1300.0020, Minnesota Plumbing Code, as defined in Minnesota Rules Chapter 4715, Minnesota State Fire Code, as defined in Minnesota Rules Chapter 7511, and the Sandstone City Code.”
Section 202. Amend as follows “Code Official. The official who is charged with the administration and enforcement of this code, or any duly authorized representative. For the purposes of this Code, the Code Official shall be the Building Official of the City of Sandstone.”
Section 304.2. Amend by inserting “At least 50 percent of to the beginning of the first sentence. Amend by inserting the following language at the end of the paragraph “In cases where the City Council has approved the issuance of an order to correct the deteriorated exterior of a building and a determination has been made by the Building Official that a building permit is needed for the building, 85% percent of the exterior structure will be required to be brought into compliance with this paragraph and shall be weather resistant and water tight.” (Amended Ord. Section 302.4. Delete in its entirety.
Section 302.8. Delete in its entirety.
Section 304.1.1. Delete the phrase “International Building Code or the International Existing Building Code” and insert “Minnesota State Building Code, as defined in Minnesota Rule 1300.0020.”
Section 304.7. Amend by inserting after the last sentence “[t]his requirement shall not apply to existing single family homes unless an application for a building permit is made that relates to any of these items.”
Section 304.13. Amend by inserting after the last sentence “[t]his requirement shall not apply to existing single family homes unless an application for a building permit is made that relates to any of these items.”
Section 304.14. Amend by inserting the following dates “May 1" and October 1" Amend by inserting after the last sentence “[t]his requirement shall not apply to existing single family homes unless an application for a building permit is made that relates to any of these items.”
Section 305.1.1. Delete the phrase “International Building Code or the International Existing Building Code and insert “Minnesota State Building Code, as defined in Minnesota Rule 1300.0020.”
Section 306.1.1. Delete the term “International Building Code” and insert “Minnesota State Building Code, as defined in Minnesota Rule Part 1300.0020.
Section 308. Delete in its entirety.
Section 401.3. Delete the term “International Building Code” and insert the term “Minnesota State Building Code, as defined in Minnesota Rule Part 1300.0020.”
Section 402.1. Amend by inserting after the last sentence “[t]his requirement shall not apply to existing single family homes unless an application for a building permit is made that relates to any of these items.”
Section 404.4.3. Amend the last sentence to read as follows: “[e]very bedroom in a dwelling unit shall have access to a least one water closet and lavatory located in the same dwelling.”
Section 502.5. Delete the term “International Plumbing Code” and insert the term “Minnesota Plumbing Code, as set forth in Minnesota Rules Chapter 4715.”
Section 505.1. Delete the term “International Plumbing Code” and insert the term “Minnesota Plumbing Code, as set forth in Minnesota Rules Chapter 4715.”
Section 506.3. Amend the first sentence to read as follows: “[grease interceptors and automatic grease removal devices shall be maintained in accordance with this code, the Sandstone City Code, and the manufacturer’s installation instructions.”
Section 602.2. Delete the phrase “Appendix D of the International Plumbing Code” and insert the phrase “Minnesota Plumbing Code, as set forth in Minnesota Rules Chapter 4715.” Delete the exception.
Section 602.3. Amend the first sentence to read as follows: “[h]eat supply. Every owner and operator of any building who rents, leases, or lets one or more dwelling units or sleeping units on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply functioning heating equipment for the Minnesota heating season of October 1 to April 30.” Delete both of the exceptions.
Section 602.4. Amend the first sentence by inserting the following dates in the brackets: October 1 and April 30.
Section 603.2. Amend the first sentence by inserting the following at the end of the sentence “unless the equipment or appliance is labeled as ‘unvented’ .”
Section 604.2. Amend by deleting the term “NFPA 70 in the first sentence and insert “State Electrical Code, as set forth in Minnesota Rule 1315.0200.” Change the term “dwelling units” to “non-owner occupied dwelling units” and add a sentence to the end of the paragraph that states as follows: “[t]his requirement does not apply to owner-occupied dwellings unless there is a hazard to life or safety.”
Section 604.3.1.1. Amend by deleting the term “International Building Code” and inserting “Minnesota State Building Code, as defined in Minnesota Rules Part 1300.0020.”
Section 604.3.2.1. Amend by deleting the term “International Building Code” and inserting “Minnesota State Building Code, as defined in Minnesota Rules Part 1300.0020.”
Section 605.2. Amend by adding the following sentence to the end of the paragraph “all receptacles within eight feet of water must have a ground fault circuit interrupter.”
Section 606.1. Amend by deleting the term “ASME A17.1 in the first and third sentences and insert “Minnesota State Building Code, as defined in Minnesota Rule 1300.0020.” Delete everything in the last sentence starting with “Appendix N.”
Sections 701–704. Delete all of these sections in their entirety.
Chapter 8. Delete Chapter 8 in its entirety.
Appendix. Delete the Appendix in its entirety.
   (C)   Where there is any conflict between the provisions of the IPMC and any other applicable code or ordinance enforced by or in the city, the more restrictive provisions shall apply.
   (D)   Nothing in the IPMC hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any other code or ordinance enforced by or in the city, nor shall any just or legal right or remedy of any character be lost, impaired or affected.
