§ 115.07 PLACES INELIGIBLE; LOCATION.
   (A)   No license may be issued for:
      (1)   A place or a business ineligible for a license under city ordinance or state law;
      (2)   Operation in an area where the business is not allowed pursuant to this code;
      (3)   A place or business that is currently licensed as a tattoo establishment, pawnshop, massage business or establishment that sells alcoholic beverages; or
      (4)   Operation on a premises on which taxes, assessments or other financial claims of the city or other government agency are delinquent and unpaid, unless the non-payment is not under the control of the applicant.
   (B)   Adult establishments are permitted only in the zoning districts not zoned for or reserved for residential purposes or activities, subject to the following conditions.
      (1)   An adult establishment may not be located closer than 1,000 feet from any other adult establishment in the city. Measurements are to be made in a straight line without regard to city boundaries, intervening structures or objects, from the nearest point from the actual business premises of the adult establishment business to the nearest point of the actual business of any other establishment.
      (2)   An adult establishment may not be located closer than 1,000 feet from any residential lot line, place of worship, school, public park, open space, licensed family day care home, licensed group day care home, public library, licensed child care or day care center in the city. Measurements will be made in a straight line without regard to city boundaries, intervening structures or objects, from the nearest point of the actual business premise of the adult establishment to the nearest property line of the premises or building used as a dwelling or residence, place of worship, school, public park, open space, licensed family day care home, licensed group day care home, public library, licensed child care or day care center.
      (3)   An adult establishment may not be located closer than 1,000 feet from a residential lot line, residential zoning district or residential planned unit development in the city. Measurements are to be made in a straight line without regard to city boundaries, intervening structure objects, from the nearest point of the actual business premise of the adult establishment to the nearest residential lot line, boundary of the residential zoning district or residential planned unit development.
